Assistance to Live Organ Donors Programme and Ministerial Direction Amendment 2017

This instrument is made under sections 5 and 124(1)(d) of the Social Security Act 1964 by the Minister for Social Development.

Instrument

1. Title

This instrument is the Assistance to Live Organ Donors Programme and Ministerial Direction Amendment 2017.

2. Commencement

This instrument comes into force on 1 December 2017.

3. Principal direction and programme

This instrument amends the Assistance to Live Organ Donors Programme1 (as established and approved on 18 January 2005) (“principal programme”) and the Assistance to Live Organ Donors Direction given on the same date (“principal direction”).

Part 1

Amendments to principal programme

4. New clause P2A inserted

After clause P2, insert:

“P2A Expiry

This programme expires on the close of 26 February 2018.”

5. Clause P6 amended (Income assistance: eligibility)

In clause P6(1), after “to an applicant”, insert “who applies for that assistance on or before 4 December 2017”.

6. Clause P8 amended (Commencement and termination of income assistance)

In clause P8(2), after “surgical operation” insert “and before 5 December 2017”.

7. Clause P10 amended (Childcare assistance: eligibility)

In clause P10(1), before paragraph (a), insert:

“(aa) applies for assistance under this programme on or before 4 December 2017; and”

Amendments to principal direction

8. New clause D2A inserted

After clause D2, insert:

“D2A Expiry

This direction expires on the close of 26 February 2018.”

Explanatory note

This note is not part of the instrument but is intended to indicate its general effect.

This instrument amends the Assistance to Live Organ Donors Programme (“Programme”) and Ministerial Direction consequentially on the Compensation for Live Organ Donors Act 2016 coming into force on 5 December 2017. The amendments allow income assistance and childcare assistance under the Programme to be only granted to a person who applies for assistance under the Programme on or before 4 December 2017.

The instrument inserts new clauses that revoke the Programme and Ministerial direction on 26 February 2018. This coincides with the maximum period that assistance can be provided under the Programme to a person who applied for it on 4 December 2017.
