Notice of Recognition of Documents Under the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999

Pursuant to Regulation 22 of the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999, I, Simon Humphries, in exercise of those powers delegated to me by the Secretary of Labour, hereby give notice of recognition of the documents listed below submitted by Fonterra Co-operative Group Limited (Darfield Site):

  1. Application for Recognition to Enable the Use of Extended Pressure Equipment Inspection Intervals, by Fonterra Darfield, dated 28th November 2016;
  2. Submission for Recognition of Extended Inspection Intervals for Boiler and Associated Pressure Equipment at Fonterra Darfield, dated 15th December 2016 by Carlwyn Williams;
  3. Fonterra Limited – Darfield, Assure Quality ISO9001:2008 Certification;
  4. A000028-ITP-001 Rev 1 Darfield OITP, dated 15th December 2016, Overall Inspection & Test Plan for Pressure Equipment; and
  5. A000028-Rep-001 Rev001, dated 18th January 2017, Extended Intervals of Inspection AS/NZS 3788 Compliance Audit.

The Fonterra Limited (Darfield) submission indicates that this equipment would be managed in a manner consistent with the requirements of the Health and Safety in Employment (Pressure Equipment, Cranes and Passenger Ropeways) Regulations 1999 (“PECPR Regulations”). Accordingly, I advise that recognition of the Fonterra Limited (Darfield) inspection programme, as set out in the above documentation, is granted under Regulation 22 of the PECPR Regulations.

This recognition is subject to the following conditions:

  1. It applies only to pressure equipment scheduled tabled in document [4] in the section “Site PECPR Pressure Equipment List” included in document [4] (A000028-ITP-001) as supplied and noted above.
  2. Inspection periods shall not exceed the maximum permitted by 4.4.4.1(b) “Extended Interval” of AS/NZS 3788.
  3. Pressure Equipment Integrity Limited (its nominated Recognised Inspection Body) shall determine the frequency and timing of the attendance of its equipment inspectors at Fonterra Limited (Darfield) for the purpose of reviewing, approving and auditing the implementation of the ITP and for the inspection and certification of equipment.
  4. Fonterra Limited (Darfield) shall advise Pressure Equipment Integrity Limited (its nominated Recognised Inspection Body) of any changes to its equipment or process that may affect equipment life or the frequency or type of inspection applied. Fonterra Limited (Darfield) shall, in conjunction with the Recognised Inspection Body, review actual or proposed changes to its equipment or process in order to establish any potential impact on safety and equipment inspection.
  5. Fonterra Limited (Darfield) shall advise Pressure Equipment Integrity Limited (its nominated Recognised Inspection Body) of any changes to, or affecting, Fonterra Limited (Darfield) engineering personnel.
  6. Fonterra Limited (Darfield) shall review its quality management system and update it to accommodate any changes necessary following the granting of this recognition.

This recognition may be withdrawn should the services of Pressure Equipment Integrity Limited (its nominated Recognised Inspection Body) be discontinued or, if there is any significant change to the equipment or process.
