Pursuant to sections 47(3) and 395(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting, during the period from 27 January 2017 to 16 February 2017 inclusive, of the following exemptions:

  • 2 from Maritime Rule 19.3 – Maritime Transport Operator – Certification and Responsibilities – Requirement to hold Maritime Transport Operator Certificate.
  • 2 from Maritime Rule 19.41 – Maritime Transport Operator – Certification and Responsibilities – Maritime Transport Operator Plan requirements.
  • 2 from Maritime Rule 19.42(1) – Maritime Transport Operator – Certification and Responsibilities – Develop and document maritime transport operator safety system in the Maritime Transport Operator Plan.
  • 2 from Maritime Rule 19.43(1) – Maritime Transport Operator – Certification and Responsibilities – Develop and apply a survey plan.
  • 2 from Maritime Rule 19.45(1) – Maritime Transport Operator – Certification and Responsibilities – Develop and apply a maintenance plan.
  • 2 from Maritime Rule 19.46(1) – Maritime Transport Operator – Certification and Responsibilities – Develop relevant safety equipment list and a spare parts list.

  • 1 from Maritime Rule 40G.5(1)(a) – Design, Construction and Equipment – Novel ships – Owner must ensure safety case contains relevant particulars set out in Appendix 1 for the design, construction, equipment and operation of the ship.

  • 1 from Maritime Rule 45.27(1)(a) – Navigational Equipment – Ships of 500 tons gross tonnage or more to which SOLAS is not applied – Gyro-compasses – Fishing ship of 45 metres or more in length that is constructed on or after 1 September 1984 must be fitted with a gyro-compass that meets the requirements of the International Maritime Organization Assembly Resolution A.424(XI).
  • 1 from Maritime Rule 90.21(2) – Pilotage – Requirement to hold pilot licence or pilotage exemption certificate (PEC) – No person may navigate a ship within a pilotage area unless the pilot has a current, appropriate licence or PEC and has the conduct of the ship.
  • 1 from Maritime Rule 91.5(1) – Navigation Safety Rules – Operating requirements – Minimum age for operating powered vessels – No person under the age of 15 years shall be in charge of, or propel or navigate a power driven vessel unless under direct supervision.
  • 1 from Maritime Rule 91.5(2) – Navigation Safety Rules – Operating requirements – Minimum age for operating powered vessels – Owner of power driven vessel must not allow any person under the age of 15 years be in charge of or propel or navigate the vessel unless under direct supervision.
  • 1 from Maritime Rule 190.3(2) – Mandatory Ships Routeing – Poor Knights Islands – The owner, charterer and master of a ship must not cause or allow the ship to enter the Poor Knights area in transit.
