Notice of Exemption From Maritime Rules and Marine Protection Rules

Pursuant to sections 47(3) and 395(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions for the period 13 November 2017 to 24 November 2017 inclusive:

  • 1 from Maritime Rule 31.25(1) – Crewing and Watchkeeping – General crewing and other requirements – Duty of crew to hold certificates and to be able to demonstrate ancillary proficiencies – Specific certificate or endorsement or higher grade of certificate or endorsement.
  • 1 from Maritime Rule 31.84(2)(b) – Crewing and Watchkeeping – Minimum crewing requirements for other ships – Seafarers holding minimum required certificates and minimum number of crew specified applicable table and flowchart.
  • 1 from Maritime Rule 31.84(4)(b), Table 11 – Crewing and Watchkeeping – Minimum crewing requirements for other ships – Applicable tables and flow-charts for passenger ships operating within enclosed water limits.
  • 1 from Maritime Rule from 31.86(1)(a) – Crewing and Watchkeeping – Minimum crewing requirements for fishing vessels – Seafarers holding the minimum required certificates.
  • 1 from Maritime Rule 31.86(2)(d), Table 19 – Crewing and Watchkeeping – Minimum crewing requirements for fishing vessels operating within enclosed water limits.
  • 1 from Maritime Rule 32.10(1) – Seafarer Certification – Requirement to hold certificate and associated endorsements – No person may operate commercial ships, exercise privileges, or hold himself or herself out to be person entitled to exercise the privileges.
  • 1 from Maritime Rule 40A.13(2) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Intact stability of a ship must be determined in accordance with Appendix 1.
  • 1 from Maritime Rule 40A.56(1), Appendix, 4.3, survival craft (1) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Life-saving appliances – Owner and master of a ship must ensure that life-saving appliances are provided in accordance with the requirements of Appendix 4 – Restricted limit ships – Inshore limits ship 24m or more but less than 45m in length overall.
  • 1 from Maritime Rule 40A.56(1), Appendix, 4.3, survival craft (3) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Life-saving appliances – Owner and master of a ship must ensure that life-saving appliances are provided in accordance with the requirements of Appendix 4 – Restricted limit ships – Enclosed water limits ship 24m or more in length overall.
  • 1 from Maritime Rule 40C.4(1) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Permanent markings of Maritime New Zealand numbers on ships built prior 4 September 2008.
  • 1 from Maritime Rule 40C.51(1) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Provision of fire appliances in accordance with requirements of Appendix 2.
  • 1 from Maritime Rule 40C.52(1) – Design, Construction and Equipment – Passenger ships that are not SOLAS ships – Provision of life-saving appliances in accordance with requirements of Appendix 3.
  • 1 from Maritime Rule 40C.52(1), Appendix 3, 3.2, Survival craft (2)(a) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Life-saving appliances – Offshore limit ships and coastal limit ships – One lifeboat or rescue boat capable of being launched on one side of ship.
  • 1 from Maritime Rule 40C.52(1), Appendix 3, 3.2, Lifebuoys (2) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Life-saving appliances – Offshore limit ships and coastal limit ships – One lifebuoy on each side of the ship must be fitted with a buoyant lifeline.
  • 1 from Maritime Rule 40C.53(1) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Provision of radiocommunication equipment must be provided on a ship proceeding beyond enclosed waters in accordance with requirements of Appendix 4.
  • 1 from Maritime Rule 45.27(1)(a) – Navigational Equipment – Ships of 500 tons gross tonnage or more to which SOLAS is not applied – Gyro-compasses – Fishing ship of 45m or more in length that is constructed on or after 1 September 1984 must be fitted with a gyro-compass that meets the requirements of the International Maritime Organization Assembly Resolution A.424(XI).
  • 1 from Maritime Rule 47.3(4) – Load Lines – Submersion – Appropriate load line on the sides of the ship are not submerged at any time when the ship commences a voyage, during the voyage, or on arrival.
  • 1 from Maritime Rule 50.9(1) – Medical Stores – Scale 4 – Ships operating in the unlimited area.
  • 1 from Maritime Rule 73.4(1) – Logbooks – Requirement to carry a New Zealand official logbook on board the ship in the form specified.
  • 1 from Maritime Rule 91.5(1)–(2) – Navigation Safety Rules – Operating requirements – Minimum age for operating power-driven vessels.
  • 1 from Marine Protection Rule 122.4(1)–(2) – Marine Protection Products – Oil – Oil filtering equipment – Applies to ships of 400 gross tonnage or more, approved by the Director, and designed to ensure any oily mixture, which is discharged into the sea after passing through the system, has an oil content not exceeding 15 parts per million.
  • 2 from Marine Protection Rule 122.7(5) – Marine Protection Products – Oil – Oil residue (sludge) tanks – Designated pump for disposal and no discharge connections to the bilge system, oily bilge water holding tank, tank top, or oily water separators.
