Notice Title: Authorised Access to Certain Names and Addresses Held on the Motor Vehicle Register

Pursuant to section 241 of the Land Transport Act 1998 (“Act”), I authorise the following person, for the purposes and the term, and on the conditions stated below, to have access to the names and addresses of persons:

who are currently registered in respect of a motor vehicle(s); and
who have not instructed the Registrar of Motor Vehicles to withhold their details.

Person: Centrix Group Limited

Purposes:

To check or confirm details where the client has an existing security interest in the relevant motor vehicle;
for a client who holds an authorisation under section 241 of the Act, or who has a right to such information for one of the purposes of the Motor Vehicle Register set out in section 235 of the Act, information may be provided for the purposes for which the client is allowed access;
to allow registered persons to be contacted where the client is in lawful possession of the vehicle, but the owner is unknown;
to allow credit providers, including banks, to verify information provided by customers where consent to obtain this information has been given by the person to whom it relates;
for a client who is a debt collector, to assist in recovering debts where the debt collector has, or has been engaged as an agent by a person who has, a security interest in the relevant vehicle; and
to perform electronic identification checks on the clients of Centrix Group Limited customers in accordance with the current Identity Verification Code of Practice (Anti-Money Laundering and Countering Financing of Terrorism Act 2009).

Term: For a period of five years commencing on 28 September 2017 and ending at midnight on 27 September 2022.

Conditions

The personal information is accessed only by the applicant on its own behalf and solely for its own use;
the personal information is accessed only for the specified purposes;
the fees charged for the provision of the personal information from the Motor Vehicle Register are duly paid;
any identified instances of unauthorised access are immediately notified to the NZ Transport Agency and the Privacy Commissioner;
before being permitted to access the Motor Vehicle Register under section 241 of the Act, all staff must receive training that emphasises that such access must only be for the specified purposes, and refresher training must be undertaken at appropriate intervals;
access must be restricted solely to members of staff for whom authorised access is essential to achieving the specified purpose;
the personal information obtained under this authorisation shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving a specified purpose;
transaction records must be kept for a period of 12 months from the date on which an enquiry was made. Those records need to show date, plate number, and the purpose. Those records are to be provided to the NZ Transport Agency on request, to assist with any audit process;
Centrix Group Limited must provide an annual report to the NZ Transport Agency on Centrix Group Limited’s compliance with the conditions set out in this letter by 1 October each year beginning with 1 October 2018; and
compliance with the terms and conditions, if any, imposed by the NZ Transport Agency for access to Motor Vehicle Register information.
