Notice of Exemption From Maritime and Marine Protection Rules

Pursuant to sections 47(3) and 395(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting, during the period from 23 June 2017 to 14 August 2017, of the following exemptions:

  • 1 from Maritime Rule 31.25(1) – Crewing and Watchkeeping – General crewing and other requirements – Duty of crew to hold certificates and to be able to demonstrate ancillary proficiencies – Specific certificate or endorsement or higher grade of certificate or endorsement.
  • 1 from Maritime Rule 31.42(a) – Crewing and Watchkeeping – SOLAS and STCW ships – Minimum watchkeeping and special crewing requirements – Prescribed endorsements or ancillary proficiencies as required by a Minimum Safe Crewing Document.
  • 1 from Maritime Rule 31.42(c) – Crewing and Watchkeeping – SOLAS and STCW ships – Minimum watchkeeping and special crewing requirements – Ships operating within coastal and offshore limits.
  • 2 from Maritime Rule 31.43(1) – Crewing and Watchkeeping – SOLAS and STCW ships – Unlimited area – Requirements to carry navigational and engine room watchkeepers, and a cook holding qualifications and demonstrating ancillary proficiencies.
  • 1 from Maritime Rule 31.44 – Crewing and Watchkeeping – SOLAS and STCW ships – Coastal and offshore limits – Ships operating beyond restricted limits but within coastal limits or offshore limits must carry navigational or engine room watchkeepers.

  • 1 from Maritime Rule 32.10(1) – Seafarer Certification – Requirement to hold certificate and associated endorsements – No person may operate commercial ships, exercise privileges, or hold himself or herself out to be person entitled to exercise the privileges.
  • 1 from Maritime Rule 32.61(2) – Seafarer Certification – National certificates of proficiency and competency and national prescribed endorsements – Skipper restricted limits endorsed to 24 metres.
  • 2 from Maritime Rule 40A.7(1) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Approval of ship’s design.
  • 1 from Maritime Rule 40A.9(3) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Ships post-27 May 2004 of 7.5 metres or more in length must be constructed under survey.
  • 1 from Maritime Rule 40A.12(4)(a) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – General passenger ships – Subdivision and stability – Doorways and other access openings must not be fitted in the collision bulkhead below the freeboard deck.
  • 1 from Maritime Rule 40A.55(1), Appendix 3, 3.3, Fire pumps, (3)(a) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Fire-fighting appliances – Owner and master of a ship must ensure fire appliances are provided in accordance with requirements of Appendix 3 – Restricted limit ships – Power-operated fire pump and manually operated fire pump.

  • 1 from Maritime Rule 40C.51(1), Appendix 2, 2.3, Fire crew outfits, (3)(a) – Design, Construction and Equipment – Passenger ships that are not SOLAS ships – Fire-fighting appliances – Restricted coastal and restricted limit ships – Carriage of 1 fire crew outfit and 1 breathing apparatus.
  • 1 from Maritime Rule 40D.34(1) – Design, Construction and Equipment – Fishing ships – Stability and associated seaworthiness – Ships of less than 24 metres in length – Compliance with intact stability requirements.
  • 1 from Maritime Rule 40D.34(2) – Design, Construction and Equipment – Fishing ships – Stability and associated seaworthiness – Ships of less than 24 metres in length – Actual displacement and position of the centre of gravity for the lightship condition must be determined from the results of an inclining experiment.
  • 1 from Maritime Rule 40E.4 – Design, Construction and Equipment – Sailing ships – Owner/operator obligations.
  • 1 from Maritime Rule 42B.57(1) – Safety Equipment – Fire Appliances Performance Standards – Portable fire extinguishers – All portable fire extinguishers must comply with the size and classification ratings.
  • 1 from Maritime Rule 45.21(1)(a)(ii) – Navigational Equipment – Magnetic compasses – Small passenger and non-passenger ships, fishing ships – Passenger ship six metres or more in length that does not proceed beyond restricted limits must be fitted with a magnetic compass capable of being adjusted.
  • 1 from Maritime Rule 45.21(1)(b) – Navigational Equipment – Magnetic compasses – Small passenger and non-passenger ships, fishing ships – Non-passenger ships must be fitted with an adjustable magnetic compass.
  • 1 from Maritime Rule 47.65(5) – Load Lines – Ships of less than 24 metres in length – Conditions of assignment – Provision of minimum freeing port area on each side of the ship in each well.
  • 1 from Maritime Rule 51.23(2) – Crew accommodation – Heating, ventilation, lighting, and drainage – Natural light for every part of the crew accommodation.

  • 1 from Maritime Rule 82, Appendix 2, 2.17.1 – Commercial Jet Boat Operations (River) – Commercial jet boat standards – Personal flotation devices – Each person on board must be provided with a personal flotation device.
  • 1 from Maritime Rule 82, Appendix 2, 2.18.1 – Commercial Jet Boat Operations (River) – Commercial jet boat standards – Other equipment to be carried on commercial jet boats – Rope, spare plug, first aid kit, and hand-held flares.
  • 1 from Maritime Rule 90.45(1)(b)–(c) – Pilotage – Pilot Licences – Currency requirements – Continues to meet the recent experience requirements and has satisfactorily completed an annual assessment of proficiency.
  • 1 from Marine Protection Rule 122.4(1)–(2) – Marine Protection Products – Oil – Oil filtering equipment – Applies to ships of 400 gross tonnage or more, approval by the Director, and designed to ensure any oily mixture, which is discharged into the sea after passing through the system, has an oil content not exceeding 15 parts per million.
