Notice of Exemption From Maritime Rules: 19.3; 19.41; 19.42(1); 19.43(1); 19.45(1); 19.46(1); 19.62(1); 25.4(1); 40C.7(1); 40C.9(1); 40C.51(1); 40C.52(1); 40C.53(1); 45.5(1); 45.5(2); 45.21(1)(b); 50.9(1)

Pursuant to section 47(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting, during the period from 21 April 2017 to 5 May 2017, of the following exemptions:

  • 2 from Maritime Rule 19.3 – Maritime Transport Operator – Certification and Responsibilities – Requirement to hold Maritime Transport Operator Certificate.
  • 2 from Maritime Rule 19.41 – Maritime Transport Operator – Certification and Responsibilities – Maritime Transport Operator Plan requirements.
  • 2 from Maritime Rule 19.42(1) – Maritime Transport Operator – Certification and Responsibilities – Develop and document maritime transport operator safety system in the Maritime Transport Operator Plan.
  • 2 from Maritime Rule 19.43(1) – Maritime Transport Operator – Certification and Responsibilities – Develop and apply a survey plan.
  • 2 from Maritime Rule 19.45(1) – Maritime Transport Operator – Certification and Responsibilities – Develop and apply a maintenance plan.
  • 2 from Maritime Rule 19.46(1) – Maritime Transport Operator – Certification and Responsibilities – Develop relevant safety equipment list and a spare parts list.
  • 2 from Maritime Rule 19.62(1) – Maritime Transport Operator – Certification and Responsibilities – Operating Requirements – Maritime transport operator responsible for safe ships – Valid Certificate of Survey issued under Rule 44.41.
  • 1 from Maritime Rule 25.4(1) – Nautical Charts and Publications – Area requirements – Owner and master of vessel must ensure nautical charts, nautical publications, IAMSAR manual, and tables, are carried on the vessel.
  • 1 from Maritime Rule 40C.7(1) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Design and survey construction – Design – Design approval requirements on ships pre-27 May 2004 and post-27 May 2004.
  • 1 from Maritime Rule 40C.9(1) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Design and survey construction – Construction – Construction of a ship must provide strength for safe operation of ship to withstand sea and weather conditions.
  • 1 from Maritime Rule 40C.51(1) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Provision of fire appliances in accordance with requirements of Appendix 2.
  • 1 from Maritime Rule 40C.52(1) – Design, Construction and Equipment – Passenger ships that are not SOLAS ships – Provision of life-saving appliances in accordance with requirements of Appendix 3.
  • 1 from Maritime Rule 40C.53(1) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Provision of radiocommunication equipment must be provided on a ship proceeding beyond enclosed waters in accordance with requirements of Appendix 4.
  • 1 from Maritime Rule 45.5(1) – Navigational equipment – All New Zealand ships – Sextant, chronometer, and binoculars – Ships proceeding beyond unlimited area must be provided with at least one sextant.
  • 1 from Maritime Rule 45.5(2) – Navigational equipment – All New Zealand ships – Sextant, chronometer, and binoculars – Ships proceeding beyond unlimited area must be provided with at least one chronometer.
  • 1 from Maritime Rule 45.21(1)(b) – Navigational Equipment – Magnetic compasses – Small passenger and non-passenger ships, fishing ships – Non-passenger ships must be fitted with an adjustable magnetic compass.
  • 1 from Maritime Rule 50.9(1) – Medical Stores: Scale 4 – Ships operating in the unlimited area.
