Authorised Access to Certain Names and Addresses Held on the Motor Vehicle Register

Pursuant to section 241 of the Land Transport Act 1998 (“Act”), I authorise the following person, for the purpose and the term, and on the conditions stated below, to have access to the names and addresses of persons:

  • who are currently registered in respect of a motor vehicle(s); and
  • who have not instructed the Registrar of Motor Vehicles to withhold their details.

Person: Service stations

Purpose: To trace registered persons in respect of vehicles where the occupants fail to pay for goods or services from a Service Station.

Interpretation

service station means a site:

  1. used for the sale of fuel to the public; and
  2. for which a certificate is issued pursuant to section 82 of the Hazardous Substances and New Organisms Act 1996.

Conditions

  1. Names and addresses of registered persons are accessed only by the company on their behalf and solely for their own use;
  2. names and addresses may only be accessed for the specified purpose;
  3. the fees charged for the provision of the names and addresses from the Motor Vehicle Register (MVR) are duly paid;
  4. any identified instances of unauthorised access are immediately reported to the Secretary for Transport and the Privacy Commissioner;
  5. access must be restricted solely to a centralised location and to members of staff for whom authorised access is essential to achieving the specified purpose;
  6. before being permitted to access the MVR under section 241 of the Act, all staff must receive training that emphasises that such access must only be for the specified purpose, and refresher training of all staff must be undertaken at appropriate intervals;
  7. the names and addresses obtained under this authorisation shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving the specified purpose; and
  8. compliance with the terms and conditions, if any, imposed by the NZ Transport Agency for access to MVR information.

Term

  1. This notice takes effect on 1 May 2017 and expires on 31 October 2017.
  2. This notice ceases to have effect in respect of any service station from the earlier of the expiry date or the date from which they are granted access under the Authorised Access to the Motor Vehicle Register (Fuel suppliers – Standard Terms) Notice 2017 (see explanatory note).

The notice of authorisation to any service station from 31 October 2016 to 30 April 2017 is revoked.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice specifies the terms and conditions for access by service stations to personal information on the Motor Vehicle Register, under section 241 of the Land Transport Act 1998, and the purposes for which that information may be used.

Authorised access under this notice applies to service stations until the expiry date of 31 October 2017, unless the NZ Transport Agency advises individual fuel suppliers or service stations that they have approval under the Motor Vehicle Register (Fuel suppliers – Standard Terms) Notice 2017 from a specified earlier date.
