Authorised Access to Certain Names and Addresses Held on the Motor Vehicle Register

Pursuant to section 241 of the Land Transport Act 1998 (“Act”), I authorise the following persons, for the purposes and the term, and on the conditions stated below, to have access to the names and addresses of persons:

  • who are currently registered in respect of a motor vehicle(s); and
  • who have not instructed the Registrar of Motor Vehicles to withhold their details.

Person: Financial service providers

Purposes:

  1. To check or confirm details where the registered financial services provider has an existing security interest in the relevant motor vehicle, either in the form of a Personal Properties Securities Register (PPSR) interest or similar security interest; and
  2. to assist in verifying the Registered person of a motor vehicle when assessing an application to provide finance in relation to that vehicle.

Person: Financial service providers who are insurers

Purposes:

  1. To obtain names and addresses of persons registered in respect of vehicles that have been involved in motor vehicle accidents with the insurer’s clients;
  2. to obtain name and address details to assist in verifying that payment for claims are made to the Registered person of the vehicle; and
  3. for any other purpose that is reasonably required for the purpose of assessing or processing an insurance policy or claim in relation to a motor vehicle.

Interpretation

financial service provider has the meaning given to it by section 4 of the Financial Service Provider (Registration and Dispute Resolution) Act 2008.

insurer has the meaning given to it by section 4 of the Financial Service Providers (Registration and Dispute Resolution) Act 2008.

registered financial service provider means a financial service provider registered under section 16(1) of the Financial Service Providers (Registration and Dispute Resolution) Act 2008.

Conditions

  1. Names and addresses are accessed only by the financial service provider on its own behalf, and solely for its own use;
  2. names and addresses may only be accessed for a specified purpose;
  3. the fees charged for the provision of the names and addresses from the Motor Vehicle Register (MVR) are duly paid;
  4. any instances of unauthorised access must immediately be notified to the Secretary for Transport and the Privacy Commissioner;
  5. before being permitted to access the MVR, under section 241 of the Act, all staff must receive training that emphasises that such access must only be for a specified purpose, and refresher training of all staff must be undertaken at appropriate intervals;
  6. access must be restricted solely to members of staff for whom authorised access is essential to achieving a specified purpose; and
  7. the names and addresses obtained under this authorisation shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving a specified purpose.

Term

  1. This notice takes effect on 1 May 2017 and expires on 31 October 2017.
  2. This notice ceases to have effect in relation to any financial services provider from the earlier of the expiry date or the date from which they are granted access under the Authorised Access to the Motor Vehicle Register (Financial Service Providers – Standard Terms) Notice 2017 (see explanatory note).

The notices of authorisation to any financial services provider from 31 October 2016 to 30 April 2017 is revoked.

Explanatory note

This note is not part of the notice, but is intended to indicate its general effect.

This notice specifies the terms and conditions for access by financial service providers to personal information on the Motor Vehicle Register, under section 241 of the Land Transport Act 1998, and the purposes for which that information may be used.

Authorised access under this notice applies to registered financial service providers until the expiry date of 31 October 2017, unless the NZ Transport Agency advises individual providers that they have approval under the Motor Vehicle Register (Financial Service Providers – Standard Terms) Notice 2017 from a specified earlier date.
