Notice of Requirements for Granting of Certificates of Competence Under the Health and Safety in Employment (Mining Operations and Quarrying Operations) Regulations 2013 Amendment (No. 4)

Under Regulation 34(a) of the Health and Safety at Work (Mining Operations and Quarrying Operations) Regulations 2016, WorkSafe New Zealand gives notice of the qualifications and experience required for the granting of certificates of competence under Regulation 41 of those Regulations and the competencies required for the continuation of a certificate of competence under clause 7 of Schedule 1 of those Regulations.

1. Commencement—(1) Part 1 of this notice came into force on 23 March 2017.

(2) Part 2 of this notice comes into force on 1 January 2018.

2. Principal notice—This notice amends the “Notice of Requirements for Granting of Certificates of Competence Under the Health and Safety in Employment (Mining Operations and Quarrying Operations) Regulations 2013” (New Zealand Gazette, 18 December 2014, Issue No. 153, Notice No. 2014-au7793) (“principal notice”).

Part 1

Amendments to the principal notice to come into force on 23 March 2017

3. Certificate of competence as a manager to manage the quarrying operation specified in the certificate—The principal notice is amended by deleting the clause entitled “Certificate of competence as a site-specific site” and replacing it with the following clause:

Certificate of competence as a manager to manage the quarrying operation specified in the certificate

The applicant for a certificate of competence as a manager to manage the quarrying operation specified in the certificate must:

      1. hold a certificate of competence as a manager to manage the quarrying operation specified in the certificate under the former regulations;
      2. have passed the unit standards set out in Group F of Appendix 2; and
      3. hold a first aid certificate.”

6. Clause entitled “Examination by panel of examiners” amended—(1) The clause entitled “Examination by panel of examiners” in the principal notice is amended by revoking paragraph (3) and replacing it with the following paragraph:

“(3) Paragraph (1) applies to the following certificates of competence:

      1. site senior executive;
      2. first-class mine manager;
      3. first-class coal mine manager;
      4. A-grade opencast coal mine manager;
      5. A-grade quarry manager;
      6. A-grade tunnel manager;
      7. coal mine deputy;
      8. electrical superintendent;
      9. mechanical superintendent;
      10. ventilation officer;
      11. winding engine driver;
      12. coal mine underviewer;
      13. mine surveyor.”

7. Amendment notice revoked—The “Amendment to the Notice of Requirements for Granting of Certificates of Competence Under the Health and Safety in Employment (Mining Operations and Quarrying Operations Regulations 2013” (New Zealand Gazette, 23 April 2015, Issue No. 41, Notice No. 2015-au2314) is revoked.

Part 2

Amendments to principal notice to come into force on 1 January 2018

8. Competencies required for the continuation of a certificate of competence to which the savings provision applies—The principal notice is amended by inserting the following clause after the clause entitled “Certificate of competence as an electrical superintendent”:

Competencies required for the continuation of a certificate of competence to which the savings provision applies

    1. The holder of a certificate of competence as an A-grade quarry manager to which the savings provision applies must:
      1. have passed the unit standards set out in Group E of Appendix 2; and
      2. hold a first aid certificate.
    2. The holder of a certificate of competence as a B-grade quarry manager to which the savings provision applies must:
      1. have passed the unit standard set out in Group F of Appendix 2; and
      2. hold a first aid certificate.
    3. The holder of a certificate of competence as a manager to manage the quarrying operation specified in the certificate to which the savings provision applies must:
      1. have passed the unit standard set out in Group F of Appendix 2; and
      2. hold a first aid certificate.”
