Land Transfer Act Notice

An application under section 70 of the Land Transfer Act 1952 has been received for the removal of an easement.

The applicants claim the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 23 January 2017, the Register will be updated to record the easement as redundant.

Applicants: Grant Robert Eichstaedt, Julie May Eichstaedt and Peter John Darney, c/o Melissa Waswo, Powderham Legal Services, 131 Powderham Street, New Plymouth 4310.

Easement: Right to convey gas and rights to transmit electricity and telephonic communications over part Lot 1 DP 20210 marked “A” and “B” on DP 18171 comprised in Computer Freehold Register TNL1/628 and appurtenant to Lots 1–3 and 6–12 DP 350850 and Lots 1 and 2 DP 361195 comprised in Computer Freehold Registers 208174–208176, 208179–208185 and 248626–248627 created by Transfer 413679.2 registered on 18 August 1994 at 11.11am.

Circumstances: The easement has become redundant due to the separation of the dominant tenements from the servient tenement caused by the subdivision shown on DP 350850.
