Land Transfer Act Notice

An application, under section 70 of the Land Transfer Act 1952, has been received for the removal of an easement.

The applicant claims the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 11 March 2016, the Register will be updated to record the easement as redundant.

Applicant: Alina Bozena Suchanski, 194A Milford Road, Te Anau 9600.

Easement: Right of way over part Lot 6 DP 346565; marked “A” on DP 346565 comprised in Computer Freehold Registers 191238–191241 and appurtenant to Lots 1–11 DP 348338 comprised in Computer Freehold Registers 198394–198403, and over part Lot 1 DP 346565; marked “B” on DP 346565 comprised in Computer Freehold Register 191238 and appurtenant to Lots 2–11 DP 348338 comprised in Computer Freehold Registers 198395–198403 specified in Easement Certificate 5132410.5 registered on 21 December 2001.

Circumstances: The dominant tenement (Computer Freehold Register 198394) will become physically separated from the servient tenement by partial surrender of Easement Instrument 10103171.1, and the dominant tenements (Computer Freehold Registers 198395–198403) have become physically separated from the servient tenement by subdivision on DP 348338.
