Land Transfer Act Notice

The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of the right to convey water.

The applicant claims the right to convey water is redundant by reason of the circumstances set out below.

I intend to remove the right to convey water on Monday 19 September 2016 if no objections have been received before that date.

Application: 10225799.1.

Applicant: Queenstown Lakes District Council, c/o Lane Neave, Level 1, 2 Memorial Street, Queenstown 9300. Attention: Anna Walker.

Easement: A right to convey water over part Section 6 SO 461463 marked “C” on SO 461463 and over part Lot 5 DP 374540 marked “g–h” on DP 374540 specified in Easement Certificate 797454.16 – 5 February 1992 at 9.14am.

Circumstances: The easement serves no purpose and no longer benefits the dominant tenements due to the fact that the pipelines no longer supply water. The water supply has been discontinued by the applicant at the time the public water reticulation was implemented for the dominant and servient tenements.
