Land Transfer Act Notice

The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of an easement.

The applicant claims the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 19 September 2016, the Register will be updated to record the easement as redundant.

Applicant: Gillman Family Trustee Limited, c/o Rhodes Office Limited (Christchurch), PO Box 13444, Armagh, Christchurch 8031.

Easement: Right of way over Lot 43 DP 335365 marked “P” and “J” on DP 335365 comprised in Computer Freehold Register 145029 and over Lot 48 DP 335365 marked “Q” and “K” on DP 335365 comprised in Computer Freehold Register 145030 and appurtenant to Lots 1 to 35 (inclusive) and 41 and 43 DP 335365 comprised in Computer Freehold Registers 144988–145022 and 145027 and 145029 and in gross in favour of the Christchurch City Council created by Easement Instrument 6098524.15 registered on 30 July 2004 at 9.00am.

Circumstances: The easement is determined by the specified event defined in clause 1(e)(a) of Easement Instrument 6098524.15 being the dedication of Lots 36 and 37 DP 335365 as legal road.
