Land Transfer Act Notice

An application, under section 70 of the Land Transfer Act 1952, has been received for the removal of an easement.

The applicant claims the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 20 June 2016, the Register will be updated to record the easement as redundant.

Applicants: Gavin Stanley Frost, Carolyn Jo-Anne Frost and Denis Alan Schollum, c/o Sharon Schneebeli, Key Conveyancing Limited, PO Box 8052, Cherrywood, Tauranga.

Easement: Rights of way and water, electricity and telecommunications rights over Lot 4 DP 430665 Certificate of Title 519213 marked “AK”,“AL”, “AM”, “AN”, “AO”, “AP”, “AQ”, “AR”, “AS”, “AT”, “BC” and “BE” on DP 430665 (servient tenement) as appurtenant to Lot 1 DP 449459 Certificate of Title 578985 (dominant tenement) specified in Easement Certificate B442159.5 registered on 2 October 1997.

Circumstances: The dominant tenement has become physically separated from the servient tenement as a result of the subdivision shown on DP 449459 and the easement no longer serves the dominant tenement.
