Land Transfer Act Notice

The applicants described below have applied, under section 70 of the Land Transfer Act 1952, for the removal of an easement.

The applicants claim the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 7 June 2016, the Register will be updated to record the easement as redundant.

Applicants: Donald Harvie Gibson, Christine Anne Gibson and Douglas James Harvie, c/o Parry Field Lawyers, PO Box 8020, Christchurch 8440.

Easement: Right to drain effluent over Lots 13A and 14A DP 11274 comprised in Certificate of Title CB13K/1184, over Lot 1 DP 444786 comprised in Certificate of Title 558345 and over Lot 2 DP 444786 comprised in Certificate of Title 558346 (servient tenements) appurtenant to Lot 13 DP 11274 comprised in Certificate of Title CB518/232 and Lot 14 DP 11274 comprised in Certificate of Title CB456/39 (dominant tenements) created by Transfer 605688 registered on 31 July 1963.

Circumstances: A sewerage system has been installed by the local authority which serves the dominant tenements and therefore the easement no longer benefits the dominant land and is no longer operative.
