Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Kerry McPhail, Land Information New Zealand:

1. Pursuant to section 117(3)(b), declares the portion of stopped road described in the First Schedule to this notice to be added to the land in Computer Interest Register SA11A/170; and
2. Pursuant to sections 20(1) and 28, declares that, pursuant to an agreement to that effect having been entered into, the easement in gross described in the Second Schedule to this notice is acquired over the land of Paraone Pirika and Boydie Arama Karaka Pirika as to a 2.542310 share as executors and Trevor Henderson as to a 3.257690 share (“Grantor”), on the terms and conditions set out in the Third Schedule to this notice and shall vest in the Rotorua District Council (“Grantee”)

on the date of publication hereof in the New Zealand Gazette.

A right to sewage in gross over that part of the land in Computer Freehold Register 740629 marked “A” on DP 428010.

Easement Rights and Powers and Covenants

The Easement shall contain the rights and powers implied in such easements by the Fourth Schedule to the Land Transfer Regulations 2002.
