Special Needs Grants Amendment (No. 2) 2016

This instrument is made under section 124(1)(d) of the Social Security Act 1964 by the Minister for Social Development.

Instrument

1. Title—This instrument is the Special Needs Grants Amendment (No. 2) 2016.

2. Commencement—This instrument comes into force on the 28th day after its publication in the New Zealand Gazette.

3. Principal programme—This instrument amends the Special Needs Grants Programme1 (as established and approved on 18 December 1998) (“principal programme”).

4. Clause 7 amended (Income limits)—Replace clause 7.2 with:

7.2 In clause 7.1, an Applicant’s income includes—

      1. the income of his or her spouse or partner (if any); and
      2. if the Applicant is a dependent child, the income of his or her Parent; and
      3. any New Zealand superannuation or veteran’s pension received by any of the Applicant and his or her spouse or partner (if any).

5. Clause 18 amended (Grants to Farmers, Orchardists, etc.)—In clause 18.5, replace the definition of income with:

income, in relation to a person, includes—

      1. the income of his or her spouse or partner (if any); and
      2. any New Zealand superannuation or veteran’s pension received by any of the person and his or her spouse or partner (if any).

Explanatory note

This note is not part of the instrument, but is intended to indicate its general effect.

This instrument, which comes into force on the 28th day after its publication in the New Zealand Gazette, amends the Special Needs Grants Programme under the Social Security Act 1964 to clarify that income includes New Zealand superannuation and veteran’s pension.
