Notice of Exemption From Maritime Rules: 19.3; 19.41; 19.42(1); 19.43(1); 19.45(1); 19.46(1); 19.62(1); 31.64(1); 31.64(2)(a); 40D.7(1)(b); 40D.9(1)(b); 40D.37(1), Appendix 1, 1.1; 40D.64(1), Appendix 2, 2.3; 40D.68(1)–(2), Appendix 3, 3.3; 45.24

Pursuant to section 47(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions:

  • 1 from Maritime Rule 19.3 – Maritime Transport Operator – Certification and Responsibilities – Maritime Transport Operator Plan and maritime transport operator safety system – Requirement to hold Maritime Transport Operator Certificate
  • 1 from Maritime Rule 19.41 – Maritime Transport Operator – Certification and Responsibilities – Maritime Transport Operator Plan and maritime transport operator safety system – Maritime Transport Operator Plan and all its requirements
  • 1 from Maritime Rule 19.42(1) – Maritime Transport Operator – Certification and Responsibilities – Maritime Transport Operator Plan and maritime transport operator safety system – Maritime transport operator must develop and document a maritime transport operator safety system in the Maritime Transport Operator Plan
  • 1 from Maritime Rule 19.43(1) – Maritime Transport Operator – Certification and Responsibilities – Maritime Transport Operator Plan and maritime transport operator safety system – Survey plan – Maritime transport operator must ensure that a survey plan is developed and applied
  • 1 from Maritime Rule 19.45(1) – Maritime Transport Operator – Certification and Responsibilities – Maritime Transport Operator Plan and maritime transport operator safety system – Maintenance plan – A maritime transport operator must develop and apply a maintenance plan
  • 1 from Maritime Rule 19.46(1) – Maritime Transport Operator – Certification and Responsibilities – Maritime Transport Operator Plan and maritime transport operator safety system – Safety equipment list and spare parts list – A maritime transport operator must ensure that a relevant safety equipment list and a spare parts list, in a form acceptable to the director, are developed for each ship in the maritime transport operation
  • 1 from Maritime Rule 19.62(1) – Maritime Transport Operator – Certification and Responsibilities – Operating Requirements – Maritime transport operator responsible for safe ships – No person may operate or permit the operation of a ship in the maritime transport operation unless the ship has a valid Certificate of Survey issued under Rule 44.41
  • 1 from Maritime Rule 31.64(1) – Crewing and Watchkeeping – Fishing ships that proceed beyond the inshore fishing area other than fishing ships less than 24 metres within coastal and offshore limits – Other minimum crewing requirements for fishing vessels – Minimum required certificates and minimum number of crew
  • 1 from Maritime Rule 31.64(2)(a) – Crewing and Watchkeeping – Fishing ships that proceed beyond the inshore fishing area other than fishing ships less than 24 metres within coastal and offshore limits – Other minimum crewing requirements for fishing vessels – Applicable tables and flow charts in Table 7 – Crewing for fishing vessels – Unlimited area
  • 1 from Maritime Rule 40D.7(1)(b) – Design, Construction and Equipment – Fishing ships – Design, survey, construction and structural strength – Design – If ship is pre-27 May 2004, ship’s design is approved by surveyor who holds a current Certificate of Survey
  • 1 from Maritime Rule 40D.9(1)(b) – Design, Construction and Equipment – Fishing ships – Design, survey, construction and structural strength – Design – Ships of 12 metres of more in length – Strength and construction of the hull, superstructures, deckhouses, machinery casings, companionways and any other structures are sufficient to withstand the sea and weather conditions
  • 1 from Maritime Rule 40D.37(1), Appendix 1, 1.1 – Design, Construction and Equipment – Fishing ships – Life-saving appliances – Owner and the master of any ship must ensure that life-saving appliances are provided in accordance with the requirements of Appendix 1 – Unlimited ships – Requirements in Appendix 1.1 applying to ships that proceed in the unlimited area
  • 1 from Maritime Rule 40D.64(1), Appendix 2, 2.3 – Design, Construction and Equipment – Fishing ships – Post-27 May 2004 ships of less than 24 metres in length and post-27 May 2004 ships of 24 metres or more in length but less than 45 metres that do not proceed beyond the coastal limit – Fire appliances – Owner and master of any ship must ensure that fire appliances are provided in accordance with the requirements of Appendix 2 – Ships of less than 23 metres in length that operate in any operating limits
  • 1 from Maritime Rule 40D.68(1)–(2), Appendix 3, 3.3 – Design, Construction and Equipment – Fishing ships – Owner and master of ship must ensure radiocommunications equipment are provided, and any ship proceeding beyond offshore limits are provided with radio transponder, in accordance with Appendix 3 – Ships that proceed beyond offshore limits
  • 1 from Maritime Rule 45.24 – Navigational Equipment – All ships to which SOLAS is not applied – Magnetic compasses – Fishing ships that proceed into the unlimited area
