Pursuant to sections 162 and 163 of the Land Transport Act 1998, and after having had regard to the criteria specified in section 164(2) of that Act, I, Fergus Gammie, Chief Executive of NZ Transport Agency, make the following emergency Rule:

1. Title—This Rule is Land Transport Rule: Hurunui-Kaikōura Earthquakes 2016.

2. Commencement—This Rule comes into force on 21 December 2016.

3. Expiry—This Rule expires at the close of 20 March 2017.

4. Purpose—The purpose of this Rule is to:

(a) manage the immediate response to a sudden change in traffic volumes along certain State highways following the Hurunui-Kaikōura earthquakes on 14 November 2016 and the subsequent closure of parts of State Highway 1, in order to minimise the risk of death or injury to a person or damage to property; and

(b) allow time for more permanent measures to be developed to assist in safely managing traffic volumes along those State highways.

5. Interpretation—A term that is used in this Rule and defined in the Land Transport Act 1998 but not defined in this Rule has the meaning given in that Act.

6. Speed limits for certain State highways in the South Island—(1) The speed limits specified in the fourth column of Part A of the Schedule are the speed limits for the parts of State highways described in the three previous columns.

(2) The speed limits specified in the fourth column of Part A of the Schedule are shown in the map of State highways in Part B of the Schedule.

(3) If there is any inconsistency between Part A and Part B of the Schedule, Part A prevails.

(4) Subclause (1):

(a) applies despite any provision of Land Transport Rule: Setting of Speed Limits 2003 to the contrary; but

(b) notwithstanding paragraph (a), does not prohibit a road controlling authority from setting a temporary speed limit in accordance with section 5 of that Rule.

(5) Subclause (1) applies despite any bylaw setting a speed limit for any of the State highways, or any part of the State highways, listed in the Schedule.

7. Speed limit signage—(1) The Agency must install a speed limit sign at or near, and not more than 20m from, the point on a State highway at which a speed limit set by this Rule begins or changes.

(2) At any intersection between a State highway listed in the Schedule and any other road, the Agency must install a speed limit sign on the left-hand side of the other road at or near, and not more than 20m from, the intersection, indicating the speed limit.

(3) In addition to subclause (2), the Agency must install a speed limit sign on the right-hand side of the road, or on the central median where appropriate, at or near, and no more than 20m from, the point at which the road intersects the State highway indicating the speed limit, if the estimated two-way average daily traffic at that intersection exceeds 500 vehicles.

(4) Any speed limit signs installed in accordance with this clause must comply with Land Transport Rule: Traffic Control Devices 2004.
