Notice of Exemption From Maritime Rules 19.62(1); 31.25(1); 31.43(1)(a)–(b); 32.10(1); 40B.23(1); 40C.13(1), Appendix 1, 1.2(3); 40C.13(1), Appendix 1, 1.4; 46.17(1)(a); 47.65(5)(b); 82; 91.5(1); 91.5(2)

Pursuant to section 47(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting, during the period from 26 October 2016 to 21 November 2016, of the following exemptions:

  • 1 from Maritime Rule 19.62(1) – Maritime Transport Operator – Certification and Responsibilities – Operating Requirements – Maritime transport operator responsible for safe ships – Valid Certificate of Survey issued under Rule 44.41
  • 1 from Maritime Rule 31.25(1) – Crewing and Watchkeeping – General crewing and other requirements – Duty of crew to hold certificates and to be able to demonstrate ancillary proficiencies – Specific certificate or endorsement or higher grade of certificate or endorsement
  • 1 from Maritime Rule 31.43(1)(a)–(b) – Crewing and Watchkeeping – SOLAS ships and STCW ships – Unlimited area – Requirements for ships operating in unlimited areas to carry at least navigational and engine room watchkeepers as specified
  • 1 from Maritime Rule 32.10(1) – Seafarer Certification – Requirement to hold certificate and associated endorsements – No person may operate commercial ships, exercise privileges, or hold himself or herself out to be person entitled to exercise the privilege
  • 1 from Maritime Rule 40B.23(1) – Design, Construction and Equipment – SOLAS ships – Radiocommunications – Ship requirements – Compliance with specified regulations of Parts A and C of Chapter IV of SOLAS
  • 1 from Maritime Rule 40C.13(1), Appendix 1, 1.2(3) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – intact stability – Inclining test and stability criteria – Surveyor conducting requirements of subrules (3) to (8) must be same surveyor throughout
  • 1 from Maritime Rule 40C.13(1), Appendix 1, 1.4 – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Intact stability – Tugs – Ship engaged in towing must meet requirements of clause 1.2 as well as requirements in clause 1.4
  • 1 from Maritime Rule 46.17(1)(a) – Surveys, Certification and Maintenance – Ships which do not proceed beyond restricted limits, fishing ships, and ships of less than 45 metres in length – Inspections – Hull and external fittings inspections below the waterline with the ship out of the water at intervals not exceeding two years
  • 1 from Maritime Rule 47.65(5)(b) – Load Lines – Ships of less than 24 metres in length – Conditions of assignment – Minimum freeing port area – Where the length of the well is less than 20 metres, the freeing port area must be determined from Table 6
  • 1 from Maritime Rule 91.5(1) – Navigation Safety Rules – Operating requirements – Minimum age for operating powered vessels – No person under the age of 15 years shall be in charge of, or propel or navigate a power driven vessel unless under direct supervision
  • 1 from Maritime Rule 91.5(2) – Navigation Safety Rules – Operating requirements – Minimum age for operating powered vessels – Owner of power driven vessel must not allow any person under the age of 15 years to be in charge of or propel or navigate the vessel unless under direct supervision
