Notice of Exemption From Maritime Rules and Marine Protection Rules 31.25(1); 31.84(2)(b)(i); 31.84(4)(f), Table 15; 32.10(1); 40C.13(3), Appendix 1. 1.4; 40C.51(1), Appendix 2, 2.3(2)–(3); 42A.28(2)(b); 42B.57(1); 122.4(1)–(2)

Pursuant to section 47(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting, during the period from 7 October 2016 to 17 October 2016, of the following exemptions:

  • 1 from Maritime Rule 31.25(1) – Crewing and Watchkeeping – General crewing and other requirements – Duty of crew to hold certificates and to be able to demonstrate ancillary proficiencies – Specific certificate or endorsement or higher grade of certificate or endorsement
  • 1 from Maritime Rule 31.84(2)(b)(i) – Crewing and Watchkeeping – Ships other than ships to which subparts C and D apply – Minimum crewing requirements for other ships – Seafarers on board hold minimum requirement certificates and prescribed endorsements
  • 1 from Maritime Rule 31.84(4)(f), Table 15 – Crewing and Watchkeeping – Minimum crewing requirements for other ships – Applicable tables and flow-charts for non-passenger ships operating within enclosed water limits
  • 1 from Maritime Rule 32.10(1) – Seafarer Certification – Requirement to hold certificate and associated endorsements – No person may operate commercial ships, exercise privileges, or hold himself or herself out to be person entitled to exercise the privilege
  • 1 from Maritime Rule 40C.13(3), Appendix 1, 1.4 – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Subdivision and stability – Intact stability requirements – Tugs
  • 1 from Maritime Rule 40C.51(1), Appendix 2, 2.3(2)–(3) – Design, Construction and Equipment – Passenger ships that are not SOLAS ships – Fire-fighting appliances – Owner and the master of a ship must ensure that fire appliances are provided in accordance with the requirements of Appendix 2 of this Part – Restricted coastal and restricted limit ships – Portable fire extinguishers
  • 2 from Maritime Rule 42A.28(2)(b) – Safety Equipment – Life-Saving Appliances – Performance, Maintenance and Servicing – Launching and embarkation appliances – Vessels operating under a Safe Ship Management Certificate or a Maritime Transport Operator Certificate – Launching appliance for a life-raft, lifeboat or rescue boat must not depend on any means other than gravity or stored mechanical power
  • 1 from Maritime Rule 42B.57(1) – Safety Equipment – Fire Appliances Performance Standards – Portable fire extinguishers – All portable fire extinguishers must comply with size and classification ratings
  • 1 from Marine Protection Rule 122.4(1)–(2) – Marine Protection Products – Oil – Oil filtering equipment – Applies to ships of 400 gross tonnage or more, approval by the Director, and designed to ensure any oily mixture, which is discharged into the sea after passing through the system, has an oil content not exceeding 15 parts per million
