On 14 July 2016, the Commerce Commission (“Commission”) commenced its investigation, under clause 1(6) of Schedule 3 to the Telecommunications Act 2001 (“Act”), into whether the resale services supplied by Spark New Zealand Limited (“Spark”) should be omitted from Schedule 1 of the Act.

The Commission gives notice, under clause 2(1) of Schedule 3 to the Act, that it has prepared a draft report on whether the resale services supplied by Spark should be omitted from Schedule 1 of the Act. The draft report will be released on Friday 23 September 2016 and will be available on the Commission’s website.

The Commission also gives notice that the closing date for submissions on the draft report is 17 October 2016, and that the closing date for cross-submissions is 26 October 2016.
