Notice of Exemption From Maritime Rules and Marine Protection Rules: 25.7(1)(c)(ii); 31.42(c); 31.44; 31.82(1); 31.84(1); 31.84(2); 31.84(4)(f), Table 15; 40A.12(2); 40A.55(1), Appendix 3, 3.3; 40B.8; 40B.21(2)(a); 40C.12(1)(a); 40C.12(3)(a); 40C.51(1), Appendix 2, 2.3; 40D.83(2)(b)(iii)–(v); 42A.6; 46.11(2)(a); 46.17(1)(a); 46.17(1)(b); 47.8(2)(a); 49.6(1); 122.4(1)–(2)

Pursuant to sections 47(3) and 395(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting, during the period from 21 April 2016 to 7 June 2016, of the following exemptions:

  • 1 from Maritime Rule 25.7(1)(c)(ii) – Nautical Charts and Publications – Chart and publication requirements – Paper back-up nautical charts
  • 1 from Maritime Rule 31.42(c) – Crewing and Watchkeeping – SOLAS and STCW ships – Minimum watchkeeping and special crewing requirements – Ships operating within coastal and offshore limits
  • 1 from Maritime Rule 31.44 – Crewing and Watchkeeping – SOLAS and STCW ships – Coastal and offshore limits – Ships operating beyond restricted limits but within coastal limits or offshore limits must carry navigational or engine room watchkeepers
  • 1 from Maritime Rule 31.82(1) – Crewing and Watchkeeping – Requirement to operate under Minimum Safe Crewing Document for some ships

  • 3 from Maritime Rule 46.17(1)(a) – Surveys, Certification and Maintenance – Ships which do not proceed beyond restricted limits, fishing ships, and ships of less than 45 metres in length that are not required to comply with section 1 – Inspections – Hull and external fittings inspections below the waterline with the ship out of the water at intervals not exceeding two years
  • 1 from Maritime Rule 46.17(1)(b) – Surveys, Certification and Maintenance – Ships which do not proceed beyond restricted limits, fishing ships, and ships less than 45 metres in length that are not required to comply with section 1 – Inspections – Propeller shafts and rudder stocks with water-lubricated bearings at intervals not exceeding four years
  • 1 from Maritime Rule 47.8(2)(a) – Load Lines – Owner’s and master’s obligations – Section 1 – Ships of 24 metres or more in length – Owner and master must comply with and ensure compliance with this section and the provisions of Articles 2, 3, 7, 10–15, Annex I and Annex II of the Load Line Convention
  • 1 from Maritime Rule 49.6(1) – Ships’ Lifting Appliances – Thorough examination of ship’s lifting appliances and loose cargo gear by a competent person
  • 2 from Marine Protection Rules 122.4(1)–(2) – Marine Protection Products – Oil – Oil filtering equipment – Applies to ships of 400 gross tonnage or more, approval by the Director, and designed to ensure any oily mixture, which is discharged into the sea after passing through the system, has an oil content not exceeding 15 parts per million
