Pursuant to sections 4(1) and 8(1) of the Forest and Rural Fires Act 1977, the National Rural Fire Authority hereby makes the following notice.

Notice

1. Title and commencement—(1) This notice may be cited as the South Canterbury Rural Fire District Notice 1998, Constitution and Administration Amendment No. 6 and shall be read with and deemed part of the notice constituting the South Canterbury Rural Fire District Notice 1998 made on 27 July 1998 (hereinafter referred to as the principal notice*).

(2) This notice comes into force on 1 April 2016.

2. Amendment of Rural Fire District Notice—The principal notice is hereby amended by:

(1) Revoking clause 3 of the notice and substituting with the following clause:

For the purposes of the Act the district shall be administered by the Mid-South Canterbury Rural Fire Committee.

The Committee shall consist of nine members as follows:

    1. One person appointed by the Ashburton District Council, in writing under the signature of the Chief Executive;
    2. One person appointed in writing by the MacKenzie District Council under the signature of its Chief Executive;
    3. One person appointed in writing by the Timaru District Council under the signature of its Chief Executive;
    4. One person appointed in writing by the Waimate District Council under the signature of its Chief Executive;
    5. One person appointed in writing by the Department of Conservation, under the signature of its Director-General;
    6. One person appointed in writing by the New Zealand Forest Owners Association as a member representing forest owners in the district, under the signature of its President;
    7. One person appointed in writing by the Chief Executive of the New Zealand Fire Service; and
    8. Two people appointed by the Committee as independent members with recognised governance experience. The independent members will have the same rights as other members of the Committee. The term of appointment will be in accordance with the Forest and Rural Fires Regulations 2005.

This clause shall be read together with and be deemed to be part of the principal notice.

Schedule

The principal notice is hereby amended by deleting the Schedule and inserting a new Schedule as follows:

Canterbury Land District

(1) the Ashburton District, as delineated on SO 18088 but excluding all “fire districts” as defined in section 2 of the Fire Service Act 1975.

(2) the Timaru District, as delineated on SO 18094 but excluding all “fire districts” as defined in section 2 of the Fire Service Act 1975.

(3) the MacKenzie District, as delineated on SO 18101 but excluding all “fire districts” as defined in section 2 of the Fire Service Act 1975, and also excluding all of the Tekapo Military Training Area Defence Rural Fire District as delineated on SO 302746 and SO 448942.

(4) the Waimate District, as delineated on SO 18106 but excluding all “fire districts” as defined in section 2 of the Fire Service Act 1975.

(5) The boundaries are more particularly delineated on those plans NRFA 0720 entitled South Canterbury Rural Fire District, deposited in the National Office of the New Zealand Fire Service at Wellington.”

This clause shall be read together with and be deemed to be part of the principal notice.
