Land Transfer Act Notice

An application under section 70 of the Land Transfer Act 1952 has been received for the removal of an easement.

The applicant claims the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 23 May 2015, the Register will be updated to record the easement as redundant.

Applicant: Fairview Property Investment Limited, c/o Brett Norris Law, PO Box 34442, Birkenhead, Auckland 0626.

Easement: Right of way over Lot 2 DP 341647; marked “B”, “C” and “D” on DP 341647 comprised in Computer Freehold Register 171426 (servient tenement) and in favour of Lots 1–16 DP 321599 comprised in Computer Freehold Registers 86228–86243 (dominant tenements) specified in Easement Certificate D698613.7 registered on 12 April 2002.

Circumstances: The dominant tenements Lots 1–7, 10–11 and 15–16 DP 321599 have become physically separated from the servient tenement as a result of subdivision shown on DP 321599 and the dominant tenements Lots 8–9 and 12–14 DP 321599 have become physically separated from the servient tenement.
