Pursuant to section 50(1)(a) of the Ngāti Hauā Claims Settlement Act 2014, the Minister of Conservation hereby notifies that the area described in the Schedule hereto has been declared to be subject to an overlay classification by section 45 of the Act.

The provisions of the Act which relate to the overlay classification are sections 44–58.

Pursuant to section 50(1)(b) of the Act, the Minister hereby notifies that the following protection principles are directed at the Minister avoiding harm to, or the diminishing of, the Ngāti Hauā values related to Te Miro Scenic Reserve:

  1. protection of wāhi tapu, significant places, traditional materials and resources, flora and fauna, water and the wider environment of the Te Miro Scenic Reserve;
  2. recognition of Ngāti Hauā mana, kaitiakitanga, tīkanga/kawa over and within the Te Miro Scenic Reserve;
  3. respect for Ngāti Hauā tīkanga and kaitiakitanga within the Te Miro Scenic Reserve;
  4. encouragement of recognition and respect for the association of Ngāti Hauā with the Te Miro Scenic Reserve;
  5. accurate portrayal of the association and kaitiakitanga relationship of Ngāti Hauā with the Te Miro Scenic Reserve;
  6. respect for and recognition of the relationship of Ngāti Hauā with the wāhi tapu and significant places; and
  7. recognition of the interest of Ngāti Hauā in actively protecting indigenous species within the Te Miro Scenic Reserve.
