Plumbers, Gasfitters, and Drainlayers (Fees, and Disciplinary and Prosecution Levy) Notice 2016

The Plumbers, Gasfitters, and Drainlayers Board (“the board”), issues the following notice under sections 142 and 143 of the Plumbers, Gasfitters, and Drainlayers Act 2006 (“the Act”).

1. Title—This notice is the Plumbers, Gasfitters, and Drainlayers (Fees, and Disciplinary and Prosecution Levy) Notice 2016.

2. Commencement—This notice comes into force on 1 February 2016.

3. Revocation—This notice revokes the Plumbers, Gasfitters, and Drainlayers (Fees and Disciplinary Levy) Notice 2013 (“2013 notice”), published in the New Zealand Gazette, 20 December 2012, No. 151, page 4495, with effect from 1 April 2016.

4. Interpretation—(1) In this notice, unless the context otherwise requires:

licensing period means a period beginning on 1 April and finishing on 31 March the following year.

(2) Any term or expression defined in the Act that is used but not defined in this notice has the same meaning as in the Act.

5. Fees—(1) The board prescribes the fees set out in the Schedule.

(2) The fees are payable to the board at the time of application.

(3) All fees are inclusive of goods and services tax.

(4) The fee for an application for, or notification of, any of the matters set out in (a)–(d) is the annual fee required for each licensing period to which the application relates:

    1. practising licence
    2. exemption
    3. exemption under supervision
    4. trainee limited certificate.

(5) The fee for all other matters, except those identified in (4) above, is payable each time the person applies to purchase the relevant good or service.

6. Disciplinary and prosecution levy—(1) The board imposes the disciplinary and prosecution levy (“levy”) set out in the Schedule.

(2) The levy is payable to the board annually on application for a practising licence.

(3) The levy is inclusive of goods and services tax.

7. Applicable fees and levy—(1) The fees for an application which relates to the period from 1 April 2016 onwards are the fees set out in this notice and apply irrespective of when the application is made.

(2) The fees for an application which relates to the period ending on 31 March 2016 are the fees set out in the 2013 notice.

(3) The levy for an application which relates to the period from 1 April 2016 onwards is the levy set out in this notice and applies irrespective of when the application is made.

(4) The levy for an application which relates to the period ending on 31 March 2016 is the disciplinary levy set out in the 2013 notice.

8. Waiver or refund of fees and levy—The board may provide a waiver or refund, in part or whole, of any fee or levy.

Explanatory Note

This note is not part of the notice and has been included to explain its general effect.

Under section 142 of the Act, the board may prescribe fees payable in respect of certain matters. The board may also impose a disciplinary and prosecution levy on all registered persons under section 143 of the Act.

This notice sets out the fees, and disciplinary and prosecution levy payable to the board. The notice follows a review, carried out in 2015, of board fees and the disciplinary and prosecution levy, which included sector consultation.

The fees, and disciplinary and prosecution levy set in this notice apply from 1 April 2016, or in respect of any application which relates to the period from 1 April 2016 onwards irrespective of when the application is made. The fees and disciplinary levy set in the 2013 notice apply to any application which relates to the period ending on 31 March 2016.

This notice revokes the 2013 notice with effect from 1 April 2016.
