Application for Approval of a Scheme Under Part III of the Charitable Trusts Act 1957

The ROYSTON HOSPITAL TRUST BOARD (“the Board”) has applied to the High Court at Napier for approval of a scheme under Part III of the Charitable Trusts Act 1957.

The proposed scheme reorganises the Board as the ROYSTON HEALTH TRUST BOARD.

It varies the objects and rules of the Board so that it is better able to use and apply its income and capital to meet modern expectations for the provision of health services and better respond to the present and future health needs of the people and community of Hawke’s Bay.

Particularly, the scheme extends the Board’s objects beyond the direct or indirect control and operation of Royston Hospital in Hastings.

The scheme also modernises rules governing the Board’s conduct.

The proposed scheme has been approved by the Attorney-General, as required by the Act.

The application is to be heard before the High Court at Napier on 28 July 2015 at 10.00am.

Any person who wishes to oppose the application must give notice in writing of their intention to do so not less than seven days before the date of the hearing, to:

  1. the Registrar of the High Court at Napier;
  2. the Board, whose address for service is Gifford Devine, 206 Queen Street East, Hastings (Attention: N. Dent); and
  3. the Attorney-General, whose address for service is the Crown Law Office, Level 3, Justice Centre, 19 Aitken Street, Thorndon, Wellington 6140 (Attention: H. Carrad).

Copies of the proposed scheme, originating application and affidavit in support may be inspected free of charge at the office of Gifford Devine, located at 206 Queen Street East, Hastings.
