Notice of Exemption From Maritime Rules: 19.62(1); 31.42(a); 31.42(c); 31.44; 31.82(1); 31.84(1); 31.84(2)(b); 40A.3(1); 40A.36(2); 40A.56(1), Appendix 4, 4.3; 40C.51(1), Appendix 2, 2.1; 40C.52(1), Appendix 3, 3.1; 40D.13(2), Table 2; 40D.18(2); 40D.64, Appendix 2, 2.2; 42B.20(10); 45.27(1)(a); 46.17(1)(a)

Pursuant to section 47(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions:

  • 1 from Maritime Rule 19.62(1) – Maritime Transport Operator – Certification and Responsibilities – Operating Requirements – Maritime transport operator responsible for safe ships – No person may operate or permit the operation of a ship in the maritime transport operation unless the ship has a valid Certificate of Survey issued under Rule 44.41
  • 1 from Maritime Rule 31.42(1) – Crewing and Watchkeeping – SOLAS and STCW ships – Minimum watchkeeping and special crewing requirements – Owner and master of ship in Rule 31.40(1) must not operate that ship unless there are on board at least minimum number of crew holding special crewing requirements
  • 1 from Maritime Rule 31.42(c) – Crewing and Watchkeeping – SOLAS and STCW ships – Minimum watchkeeping and special crewing requirements – Owner and master of ship in Rule 31.40(1) must not operate that ship unless there are on board minimum number of crew holding certificates prescribed in 31.44, in relation to ships operating within the coastal and offshore limits
  • 1 from Maritime Rule 31.44 – Crewing and Watchkeeping – SOLAS and STCW ships – Coastal and offshore limits – Ships operating beyond restricted limits but within coastal limits or offshore limits must carry at least navigational or engine room watchkeepers
  • 1 from Maritime Rule 31.82(1) – Crewing and Watchkeeping – Ships other than ships to which subparts C and D apply – Requirement to operate under Minimum Safe Crewing Document for some ships – Owner and master of a passenger or non-passenger ship must not operate that ship unless there are at least the minimum number of crew including seafarers certificate or prescribed endorsements on board
  • 1 from Maritime Rule 31.84(1) – Crewing and Watchkeeping – Ships other than ships to which subparts C and D apply – Minimum crewing requirements for other ships – This rule applies to a passenger or non-passenger ship other than a ship listed in rule 31.82(2)
  • 1 from Maritime Rule 31.84(2)(b) – Crewing and Watchkeeping – Crewing and Watchkeeping – Minimum crewing requirements for other ships – Owner and master of ship must not operate ship unless there are seafarers holding minimum qualifications and minimum crew on board
  • 2 from Maritime Rule 40A.3(1) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – General – Application – Application of this Part to every New Zealand ship that is a passenger ship that does not proceed beyond restricted limits; or is less than 45 metres in length and does not proceed beyond the offshore limit
  • 1 from Maritime Rule 40A.36(2) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – General passenger ships – Machinery – Steering gear – When a steering gear is fitted with a remote control, other arrangements must be provided to effectively steer the ship in the event of failure of the remote control
  • 1 from Maritime Rule 40A.56(1), Appendix 4, 4.3 – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Life-saving appliances – Owner and master of a ship must ensure that life-saving appliances are provided in accordance with the requirements of Appendix 4 of this Part – Restricted limit ships
  • 1 from Maritime Rule 40C.51(1), Appendix 2, 2.1 – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Fire-fighting appliances – Owner and the master of a ship must ensure that fire appliances are provided in accordance with the requirements of Appendix 2 of this Part – Ships of less than 500 gross tonnage that undertake an international voyage
  • 1 from Maritime Rule 40C.52(1), Appendix 3, 3.1 – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Life-saving appliances – Owner and master of ship must ensure that life-saving appliances are provided in accordance with requirements of Appendix 3 of this Part – Ships of less than 500 gross tonnage that undertake an international voyage
  • 1 from Maritime Rule 40D.13(2), Table 2 – Design, Construction and Equipment – Fishing Ships – Design survey, construction and structural strength – Weathertight doors – Height above deck of sills in doorways, companionways, superstructure and machinery casings exposed to weather and sea must be as given in Table 2
  • 1 from Maritime Rule 40D.18(2) – Design, Construction and Equipment – Fishing Ships – Design survey, construction and structural strength – Air pipes – In any ship of 12 metres or more in length, the height of air pipes above deck to the point where water may have access below must be at least 760mm on the working deck, and at least 450mm on the superstructure deck
  • 1 from Maritime Rule 40D.64, Appendix 2, 2.2 – Design, Construction and Equipment – Fishing Ships – Post-27 May 2004 ships of less than 24 metres in length and post-27 May 2004 ships of 24 metres or more in length but less than 45 metres that do not proceed beyond the coastal limit – Fire appliances – Owner and master of any ship must ensure that fire appliances are provided in accordance with the requirements of Appendix 2 – Ships of 45 metres or more in length but less than 60 metres in length that operate in any operating limits, and ships of 24 metres or more in length but less than 45 metres in length that proceed beyond the coastal limit
  • 1 from Maritime Rule 42B.20(10) – Safety Equipment – Fire Appliances Performance Standards – Fixed gas fire-extinguishing systems – General – Pressure containers required for the storage of fire extinguishing medium must be located outside protected spaces in accordance with rule 42B.20(13)
  • 1 from Maritime Rule 45.27(1)(a) – Navigational Equipment – Ships of 500 tons gross tonnage or more to which SOLAS is not applied – Gyro-compasses – Fishing ship of 45 metres or more in length that is constructed on or after 1 September 1984 must be fitted with a gyro-compass that meets the requirements of the International Maritime Organization Assembly Resolution A.424(XI)
  • 3 from Maritime Rule 46.17(1)(a) – Surveys, Certification and Maintenance – Ships which do not proceed beyond restricted limits, fishing ships, and ships of less than 45 metres in length – Inspections – Hull and external fittings inspections below the waterline with the ship out of the water at intervals not exceeding two years
