Notice of Exemption From Maritime Rules: 40C.9(2)(a); 40C.32(1)(a), Footnote 20; 40C.51, Appendix 2, 2.1; 40C.54(a); 42A.28(2)(b); 51.9(2); 51.15(2)(c)(v); 51.17(1)(a); 51.19(2)(a); 51.20.(4)(a); 51.33(2)(c)(iv)

Pursuant to section 47(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions:

  • 1 from Maritime Rule 40C.9(2)(a) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Design and survey construction – Construction – A post-27 May 2004 ship complies with rule 40C.9(1) if it is constructed under survey and is certified as being in accordance with hull or full certification standards for the ship’s operating limits by one of the classification societies
  • 1 from Maritime Rule 40C.32(1)(a), Footnote 20 – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – General non-passenger ships – Machinery – Inlets, discharges and sea water piping – Openings below the weather deck of ships less than 24 metres in length overall must be provided with an efficient means of closure fitted as close as possible to the side of the ship – Openings in ships of 24 metres or more in length overall that are load line ships are governed by rule 47.41
  • 1 from Maritime Rule 40C.51, Appendix 2, 2.1 – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Fire-fighting appliances – Owner and the master of a ship must ensure that fire appliances are provided in accordance with the requirements of Appendix 2 of this Part – Ships of less than 500 gross tonnage that undertake an international voyage
  • 1 from Maritime Rule 40C.54(a) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – General non-passenger ships – Anchors and cables – Post-27 May 2004 ships of 24 metres or more – The owner of a ship of 24 metres or more in length must ensure that the ship is provided with anchors and cables that comply with the requirements of a classification society listed in rule 40C.9(2)(a)
  • 1 from Maritime Rule 42A.28(2)(b) – Safety Equipment – Life-Saving Appliances – Performance, Maintenance and Servicing – Launching and embarkation appliances – For vessels operating under a Safe Ship Management Certificate or a Maritime Transport Operator Certificate, each launching appliance for a life-raft, lifeboat or rescue boat must be arranged so that the fully equipped craft it serves can be safely launched within expected conditions of trim and list during abandon ship conditions and during normal operation within the ship’s design seakeeping and loading parameters
  • 1 from Maritime Rule 51.9(2) – Crew Accommodation – Heating, ventilation, lighting, and drainage – Lighting – Every part of the crew accommodation of a ship, other than galleys, pantries, laundries, sanitary accommodation, changing rooms, passageways, drying rooms, lockers, and store rooms, must be properly lighted by natural light
  • 1 from Maritime Rule 51.15(2)(c)(v) – Crew Accommodation – Interior finish, marking, height, bulkheads, decks, panelling, and flooring – Flooring – Decks that form the floors of the crew accommodation of any ship must be covered with a material that rounded in such a way as to avoid crevices where the floor meets the walls
  • 1 from Maritime Rule 51.17(1)(a) – Crew Accommodation – Sleeping Rooms – Provision of sleeping rooms – Officers – The owner of any ship must ensure that where an individual sleeping room is provided for an officer, the floor area of that room is not less than in the case of a ship of less than 3,000 tons gross tonnage, 6.5 square metres
  • 1 from Maritime Rule 51.19(2)(a) – Crew Accommodation – Sleeping Rooms – Provision of sleeping rooms – Seafarers who are not officers – Owner of any non-passenger ship must ensure that a two-berth sleeping room provided in accordance with rule 51.16(d)(ii) for seafarers has a floor area per person of not less than in the case of a ship of less than 3000 tons gross tonnage, 2.75 square metres
  • 1 from Maritime Rule 51.20(4)(a) – Crew Accommodation – Sleeping Rooms – Provision of beds – Each bed must be not less than 1.98 metres long by 800mm wide, as measured at right angles to each other and from inside any lee-board or lee-rails
  • 1 from Maritime Rule 51.33(2)(c)(iv) – Crew Accommodation – Supply of water, laundries, clothes lockers, changing rooms, galleys, and store rooms – Galleys – Every galley must be provided with gutters and scuppers (which must be trapped) on the floor area draining overboard or to an enclosed tank served by gravity or a mechanically operated suction pump
