Pursuant to sections 47(3) and 395(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions:

  • 1 from Maritime Rule 20.21(a) – Requirement to operate within lesser of operating limits assigned to ship or operating limits that apply to Master – Operating limits that are assigned to that ship under Rule 20.20(1) and that are recorded in accordance with Rule 20.20(2)
  • 2 from Maritime Rule 22.23(1)(a), Appendix 1, Section 3(4) – Collision Prevention – Power-driven vessels underway must exhibit masthead light forward – Horizontal positioning and spacing of lights – Light must be exhibited forward amidships
  • 1 from Maritime Rule 31.42(a) – Crewing and Watchkeeping – SOLAS and STCW ships – Minimum watchkeeping and special crewing requirements – Owner and master of ship in Rule 31.40(1) must not operate that ship unless there are on board at least minimum number of crew holding special crewing requirements
  • 2 from Maritime Rule 31.44(b), Table 6 – Crewing and Watchkeeping – SOLAS and STCW ships – Coastal and offshore limits – Ships operating beyond restricted limits but within coastal limits or offshore limits must carry at least engine room watchkeepers specified in Table 6
  • 1 from Maritime Rule 31.61(2) – Crewing and Watchkeeping – Fishing ships that proceed beyond the inshore fishing area other than fishing ships less than 24 metres within coastal and offshore limits – Navigational watchkeeping arrangements and principles – Owner and master ship and any person engaged in navigational watchkeeping duties on the ship must take account of standards for navigational watchkeeping set out in Chapter IV of the Annex to STCW-F
  • 1 from Maritime Rule 31.84(1) – Crewing and Watchkeeping – Ships other than ships to which subparts C and D apply – Minimum crewing requirements for other ships – This rule applies to a passenger or non-passenger ship other than a ship listed in Rule 31.82(2)
  • 1 from Maritime Rule 31.84(2)(b)(i), Table 11 – Crewing and Watchkeeping – Ships other than ships to which subparts C and D apply – Minimum crewing requirements for other ships – Owner and master of ship must not operate ship unless seafarers on board hold minimum requirement certificates and prescribed endorsements – Crewing for passenger ships – Enclosed water limits

  • 1 from Maritime Rule 40A.40(1)(b) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Electrical systems – For ships 24 metres or less in length overall, electrical systems must comply with applicable parts of the AS/NZS 3004.2 Electrical installations – Marinas and Boats
  • 1 from Maritime Rule 40A.55(1), Appendix 3.3 – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Fire-fighting appliances – Owner and master of a ship must ensure fire appliances are provided in accordance with requirements of Appendix 3 – Restricted limit ships
  • 1 from Maritime Rule 40B.7(2) – Design, Construction and Equipment – SOLAS ships – Subdivision and stability – Owner of a ship, except those ships to which Rule 40B.8 applies, must ensure that the ship complies with applicable subdivision and damage stability requirements of Parts B, B-1, B-2, B-3 and B-4, and applicable requirements of Part A, of Chapter II-1 of SOLAS

  • 1 from Maritime Rule 40C.51(1), Appendix 2, 2.1 – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Fire-fighting appliances – Owner and the master of a ship must ensure that fire appliances are provided in accordance with the requirements of Appendix 2 of this Part – Ships of less than 500 gross tonnage that undertake an international voyage

  • 1 from Maritime Rule 40C.55(b) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Anchors and Cables – New ships of less than 24 metres – Anchors in accordance with the requirements of Tables 2A, 2B or 2C of Appendix 6, and cables in accordance with Tables 3A or 3B and 4 of Appendix 6, and the notes of the accompanying Tables 3A and 3B and 4
  • 1 from Maritime Rule 40E.22(1) – Design, Construction and Equipment – Sailing ships – Bulwarks and guard rails – Bulwarks, guardrails and toerails – A ship less than 24 metres in length that does not carry cargo must be provided with bulwarks, guardrails and toerails
  • 1 from Maritime Rule 40E.52(1), Appendix 5(1) – Design, Construction and Equipment – Sailing ships – Radiocommunications equipment – Owner and the master of a ship must ensure that radiocommunication equipment is provided in accordance with the requirements of Appendix 5 – Ships that do not proceed beyond the enclosed limit
  • 1 from Maritime Rule 42B.57(1) – Safety Equipment – Fire Appliances Performance Standards – Portable fire extinguishers – All portable fire extinguishers must comply with the size and classification ratings
  • 1 from Maritime Rule 45.21(4)(c) – Navigational Equipment – All ships to which is SOLAS is not applied – Magnetic compasses – Small passenger and non-passenger ships, and 8 fishing ships – Owner and master of ship must ensure all compasses fitted to that ship are adjusted so as to have no more than 5° deviation on any heading unless a greater deviation is specifically approved by a compass adjuster
  • 3 from Maritime Rule 46.17(1)(a) – Surveys, Certification and Maintenance – Ships which do not proceed beyond restricted limits, fishing ships, and ships of less than 45 metres in length – Inspections – Hull and external fittings inspections below the waterline with the ship out of the water at intervals not exceeding two years
  • 1 from Maritime Rule 47.65(5)(b) – Load Lines – Ships of less than 24 metres in length – Conditions of assignment – Minimum freeing port area – Where the length of the well is less than 20 metres, the freeing port area must be determined from Table 6

  • 1 from Maritime Rule 81.83(1)(a)(i) – Commercial Rafting Operations – Sole-guided commercial raft trips – Grade 1 or 2 rapids – Commercial raft operator must ensure that a guide undertaking sole-guided raft trips on rivers with grade 1 or 2 rapids, holds a national raft guide grade 2 award and has passed an assessment against national standard for river rescue
  • 1 from Maritime Rule 81.83(1)(b)(i) – Commercial Rafting Operations – Sole-guided commercial raft trips – Grade 1 or 2 rapids – Commercial raft operator must ensure that a guide undertaking sole-guided raft trips on rivers with grade 1 or 2 rapids, holds a national raft guide grade 2 award and has passed an assessment against standard for river rescue that the director is satisfied is equivalent to the national standard
  • 1 from Marine Protection Rule 122.4(1) – Marine Protection Products – Oil – Oil discharge monitoring and control system and oil filtering equipment – Applies to ships of 400 gross tonnage or more
  • 1 from Marine Protection Rule 122.4(2) – Marine Protection Products – Oil – Oil discharge monitoring and control system and oil filtering equipment – Owner must ensure that every ship is fitted with oil filtering equipment designed to ensure any oily mixture, which is discharged into the sea after passing through the system, has an oil content not exceeding 15 parts per million
