Pursuant to section 170 of the Education Act 1989, the Minister for Tertiary Education, Skills and Employment hereby gives the following notice.

N o t i c e

  1. This notice:
    1. may be cited as the Auckland University of Technology Council Constitution Notice 2015.
    2. comes into force on 1 February 2016.
  2. The Council of the Auckland University of Technology (“Council”) shall be constituted as follows:
    1. Four members appointed by the Minister by written notice to the Council;
    2. the Vice-Chancellor of the Auckland University of Technology;
    3. one permanent member of the general staff of the Auckland University of Technology elected by the permanent members of that staff;
    4. one permanent member of the academic staff of the Auckland University of Technology elected by the permanent members of that staff;
    5. one member who is a student of the Auckland University of Technology appointed by the association of students recognised by the Council of the Auckland University of Technology; and
    6. four members appointed by the Auckland University of Technology Council by resolution, in accordance with its statutes.
  3. Pursuant to section 171B of the Education Act 1989, Council shall consider the following matters when making appointments:
    1. The ethnic and socio-economic diversity of the communities served by the Auckland University of Technology;
    2. the fact that approximately half the population of New Zealand is male and half the population is female; and
    3. that at least one member of the Council is Māori.
  4. Subject to section 173 of the Education Act 1989, no member other than the Vice-Chancellor shall have more than three consecutive terms or any one term of more than four years.
  5. No act or proceeding of the Auckland University of Technology Council, or of any committee of the Council, shall be invalidated as a result of:
    1. a defect in the appointment of a member of the Council or committee; or
    2. a defect in the nomination of a member of the Council or committee for appointment as a member of the Council; or
    3. a defect in the election of a member of the Council, or committee for appointment as a member of the Council; or
    4. a disqualification of a member of the Council or of any committee of the Council; or
    5. a defect in the convening of a meeting; or
    6. a vacancy or vacancies in the membership of the Council, or of any committee of the Council.
