Pursuant to section 170 of the Education Act 1989 (“the Act”), the Minister for Tertiary Education, Skills and Employment gives the following notice.

N o t i c e

1. This notice may be cited as the University of Otago Council Constitution Notice 2015.

2. This notice shall come into force on 1 January 2016.

3. The Council of the University of Otago shall be constituted as follows:

(a) Four members appointed by the Minister for Tertiary Education;

(b) The Vice-Chancellor of the University of Otago;

(c) One permanent member of the academic staff of the University of Otago appointed following an election by the permanent members of that staff;

(d) One permanent member of the general staff of the University of Otago appointed following an election by the permanent members of that staff;

(e) The President of the Otago University Students’ Association Incorporated;

(f) Four members appointed by the University of Otago Council taking into account the specific needs of the University of Otago and the need to ensure its sound governance, such appointments to be made in accordance with its Statutes established under section 171C of the Education Act 1989.

4. In accordance with section 171B(2)(a) of the Education Act 1989, in making appointments the Minister or the Council must ensure that at least one member of the Council is Māori and appointed after consultation with Te Runanga o Ngāi Tahu.

(a) Subject to clause 5(b), appointments to the Council, other than of the Vice-Chancellor, shall be for not less than one year and not more than four years. The number of occasions on which a person may be appointed as a member of the Council is the number that, for that person, ensures that the total period for which they are a member of the Council does not exceed 12 years.

(b) Any person who is a member of the Council at the date of this notice may be appointed on the number of occasions provided for in clause 5(a) or the number of occasions which allows them to remain on the Council until 31 December 2017, whichever is the greater.

6. The powers of the University of Otago Council shall not be affected by vacancy in the membership thereof.

7. The University of Otago Notice 2013 (published in the New Zealand Gazette, 24 October 2013, No. 144, page 3951), is hereby revoked.
