Pumicelands Rural Fire District Constitution and Administration Amendment Notice 2015
Pursuant to sections 4(1) and 8(1) of the Forest and Rural Fires Act 1977 (“the Act”), the National Rural Fire Authority hereby makes the following notice.
N o t i c e
1. Title and commencement—(1) This notice is the Pumicelands Rural Fire District Constitution and Administration Amendment Notice 2015.
(2) This notice comes into force on 1 July 2015.
2. Amendment Rural Fire District Notice—The principal notice* is hereby amended by:
(1) Deleting the Schedule and inserting a new Schedule, that being the Schedule in clause 3 of this notice.
(2) Revoking clause 4 of the principal notice and substituting it with the following:
“4. Administration of the Pumicelands Rural Fire District—(1) For the purposes of the Act, the Pumicelands Rural Fire District must be administered by the Pumicelands Rural Fire District Committee.
(2) The committee consists of seven members as follows:
(a) Two individuals appointed, in writing, jointly by the chief executives of the Tauranga City Council, Western Bay of Plenty District Council, Whakatane District Council, Opotiki District Council, Kawerau District Council, South Waikato District Council, Rotorua District Council, Taupo District Council, and the Minister of Local Government, to represent the Local Territorial Authorities in the district; and
(b) two individuals appointed, in writing, by the president of the New Zealand Forest Owners Association, to represent commercial forest owners in the district; and
(c) one individual appointed, in writing, by the Director-General of the Department of Conservation; and
(d) one individual appointed, in writing, by the New Zealand Fire Service National Commander; and
(e) one individual appointed by the other members of the committee (or a majority of them) as an independent member with recognised governance experience.
(3) For the avoidance of doubt, the independent member has the same rights as the other members of the committee, with the term of appointment to be in accordance with the Forest and Rural Fires Regulations 2005.
(4) If any appointment to be made under clause 3(2) is not made within three months of the date that this notice comes into force, the National Rural Fire Officer may remedy that default by appointing such person to the vacancy as the National Rural Fire Officer considers appropriate.
(5) This clause shall be read together with and be deemed to be part of the principal notice.”
3. Schedule
Land Included in the Rural Fire District
(1) All those parcels shown on SO 58035 lodged in the office of the Chief Surveyor, South Auckland, labelled “South Waikato District”; all those parcels shown on SO 58050 lodged in the office of the Chief Surveyor, South Auckland, labelled “Mangakino-Pouakani Ward”; all those parcels shown on SO 58053 lodged in the office of the Chief Surveyor, South Auckland, labelled “Turangi-Tongariro Ward”; all those parcels shown on SO 58049 lodged in the office of the Chief Surveyor, South Auckland, labelled “Taupo District”; all those parcels shown on SO 385298 lodged in the office of the Chief Surveyor, South Auckland, labelled “Taupo-Kaingaroa Ward”; all those parcels shown on SO 58044 lodged in the office of the Chief Surveyor, South Auckland, labelled “Rotorua District” not within other Survey Notice or Local Government Plans within this notice; and all those parcels shown on LG-04-2013-Con-1 Sheet 1 lodged in the Office of the Local Government Commission, Wellington, labelled “Bay of Plenty Region General Constituencies”.
(2) All those parcels of Department of Conservation State Areas shown on Area Plans A, B, C, D, E, F, G, H, I, J, K, L, O, P, Q, R and S deposited with the plan NRFA 0716 in the National Office of the New Zealand Fire Service at Wellington.
(3) The boundaries are more particularly delineated on the plan NRFA 0716 entitled Pumicelands Rural Fire District, deposited in the National Office of the New Zealand Fire Service at Wellington.
(4) Land to be Excluded from the Rural Fire District:
