Pursuant to section 52Q of the Commerce Act 1986 (“the Act”), the Commerce Commission (“Commission”) gives notice that it has amended the information disclosure requirements applicable to electricity distribution services, gas distribution services, and gas transmission services under Part 4 of the Act.

The amended information disclosure determinations are:

• Electricity Distribution Information Disclosure Determination [2012] NZCC 22
• Gas Distribution Information Disclosure Determination [2012] NZCC 23
• Gas Transmission Information Disclosure Determination [2012] NZCC 24.

The amendments are set out in the following determinations:

• 2015 Amendment to the Electricity Distribution Information Disclosure Determination [2012] NZCC 6
• 2015 Amendment to the Gas Distribution Information Disclosure Determination [2012] NZCC 7
• 2015 Amendment to the Gas Transmission Information Disclosure Determination [2012] NZCC 8.

The amendments come into effect on the date of this notice.

The scope of the amendments cover:

• complex matters – ie Return on Investment calculation, other financial information, asset management plans, network information, director certification, disclosure of errors and transitional requirements; and
• non-complex matters – ie matters that required no or limited consultation, did not require a fundamental change to the information disclosure requirements and could be addressed without expert resource.
