Land Transfer Act Notice

An application, under section 70 of the Land Transfer Act 1952, has been received for the removal of an easement.
The applicants claim the easement is redundant by reason of the circumstances set out below.
If no objections have been received before 27 February 2014, the Register will be updated to record the easement as redundant.

Applicants: Sahra Livingstone Grinham and Dennis George Chippindale, c/o McBride Davenport James, PO Box 19001, Courtenay Place, Wellington 6149.
Easement: Right of way and a right to erect power and other poles and to lay underground wires and to convey all communications and power over Lot 2 DP 22878 (Computer Freehold Register CB6C/982), coloured yellow and blue on DP 22878, over Lot 4 DP 22878 (Computer Freehold Register CB6C/1351), coloured blue on DP 22878, over Lot 5 DP 22878 (Computer Freehold Register CB6C/1352), coloured yellow and sepia on DP 22878 and a right to drain water over Lot 5 DP 22878 (Computer Freehold Register CB6C/1352), coloured blue and sepia on DP 22878 and over Lot 3 DP 22878 (Computer Freehold Register CB6C/983), coloured blue on DP 22878 (servient tenement) in favour of Lot 4 DP 43728 (Computer Freehold Register CB25F/692) (dominant tenement) as specified in Easement Certificate 697832 registered on 16 November 1966.
Circumstances: The dominant land has become physically separated from the servient tenement as a result of subdivision shown on DP 43728 and the right of way, right to erect power and other poles and to lay underground wires and to convey all communications and power and right to drain water easements no longer serves the dominant tenement.
