Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Teresa Buckthought, Land Information New Zealand:
(a) Pursuant to section 114, declares the land described in the First Schedule to this notice to be road vested in the Whakatane District Council;
(b) Pursuant to section 116, declares the portions of road described in the Second Schedule to this notice to be stopped and, pursuant to sections 117(3) and 120(3):
(i) as to the land Firstly and Secondly described, amalgamated with the land in Computer Freehold Register 423489, subject to existing encumbrances;
(ii) as to the land Thirdly described, amalgamated
with the land in Computer Freehold Register 423490, subject to existing encumbrances;
(iii) as to the land Fourthly and Fifthly described, amalgamated with the land in Computer Freehold Register 433804, subject to existing encumbrances;
(iv) as to the land Sixthly described, amalgamated
with the land in Computer Freehold Register SA72D/946, subject to existing encumbrances;
(v) as to the land Seventhly to Thirteenthly (inclusive) described, amalgamated with the land in Computer Freehold Register SA67B/585, subject to existing encumbrances; and
(c) Pursuant to section 119, declares the land described in the Third Schedule to this notice to be taken and,
pursuant to section 120(3), amalgamated with the land in Computer Freehold Register SA72D/946, subject to existing encumbrances
on the date of publication hereof in the New Zealand Gazette.
