Pursuant to the Reserves Act 1977, the New Plymouth District Council and the Department of Conservation agree to the declaration of land as reserve and addition to the Joe Gibbs Scenic Reserve for management purposes, being a Crown-owned reserve, administered by the council by way of appointment to control and manage. To give effect to the agreement, the council hereby notifies that a resolution to the following effect was passed by the council on 6 May 2014:
"That in exercise of the powers conferred on it by Section 14 of the Reserves Act 1977, and acting under an instrument of delegation from the Minister of Conservation, the council hereby resolves that the piece of land held by the said district in an estate in fee simple, and described in the Schedule shall be and the same is declared to be gazetted for scenic reserve purposes subject to the provisions of Section 19(1)(a) of the Act and is deemed to be classified for that purpose under Section 16(2A) and further declares the said reserve form an addition to the Joe Gibbs Scenic Reserve, for management purposes, so vested in the council as the administering body and for the sake of clarity with the revisionary estate in fee simple remaining at all times with the body corporate."
