Pursuant to section 11 of the Fisheries Act 1996, the Minister for Primary Industries, after having regard to
the matters specified in sections 5, 9, 10, 11 and 12,
gives the following notice.
N o t i c e
1. Title-This notice is the Fisheries (Hagfish Sustainability Measures - Hagfish Pots) Notice 2014.
2. Commencement-This notice comes into force on
1 September 2014.
3. Interpretation-In this notice, unless the context otherwise requires:
common hagfish means a fish of the species Eptatretus cirrhatus (known as Tuere or slime-eel);
hagfish pot means a pot (whether baited or not) that is capable of taking common hagfish;
taking has the meaning given to it in the Fisheries Act 1996; and
vessel has the meaning given to it in the Fisheries Act 1996.
4. Prohibition on using or possessing hagfish pot without escape holes-(1) A person must not use or possess on a vessel a hagfish pot unless the pot has at least 100 holes (other than the entrances holes of the pot) ("escape holes") through which small common hagfish are able to escape.
(2) An escape hole must be circular and not less than 18mm in diameter.
