Fisheries (South Island Customary Fishing) Notice (No. 2) 2014 (Notice No. MPI 326)

Pursuant to Regulations 9 and 10 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Director Maori Partnership Implementation at the Ministry for Primary Industries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice (No. 2) 2014.
(2) This notice shall come into effect on 9 March 2014.
2. Interpretation-(1) In this notice:
"area/rohe moana" means the area between the Waitaki and the Pareora Rivers, extending seaward to the limit of the South Island fisheries waters as defined under Regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1999, being the 200-mile limit, and inland to boundaries defined for Te Runanga o Waihao under Te Runanga o Ngai Tahu Act 1996.
(2) Other terms used in this notice have the same meaning
as in the Fisheries (South Island Customary Fishing) Regulations 1999.
3. Cancellation of appointment-On 21 February 2014, the Minister for Primary Industries cancelled, under Regulation 10(1) of the Fisheries (South Island Customary Fishing) Regulations 1999, the appointment of Graeme Thomas as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana.
4. Nomination of Tangata Tiaki/Kaitiaki-Te Runanga o Waihao, representing the whanau and hapu of Ngai Tahu Whanui holding manawhenua manamoana over the area/rohe moana (as represented by Te Runanga o Ngai Tahu), has nominated Graeme Lane and John Wilkie as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana for further five-year terms.
5. Appointment of Tangata Tiaki/Kaitiaki-(1) On
21 February 2014, the Minister for Primary Industries appointed, under Regulation 9(5) of the Fisheries (South Island Customary Fishing) Regulations 1999, Graeme Lane and John Wilkie as Tangata Tiaki/Kaitiaki for managing customary food-gathering within the area/rohe moana.
(2) The appointments described in clause 5(1) will expire on 10 March 2019.
6. Power to authorise the taking of fisheries resources for customary food-gathering-Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996, for customary
food-gathering purposes from within the whole or any part of the area/rohe moana. No customary food-gathering of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Tiaki/Kaitiaki.
