Application for Approval of a Scheme Under Part III of the Charitable Trusts Act 1957
Notice is hereby given that the New Zealand Guardian Trust Company Limited, as trustee under the will of Iris Maud Utterson-Kelso, late of Nelson, widow, deceased, has filed an application for approval of a scheme varying the terms of the will in the Office of the High Court at Christchurch.
Under the will, part of the residue of the estate is to be held on perpetual trusts to pay the income to the Green Gables Trust Board to be used for the purposes of the Green Gables Home at Nelson. The will also directs that 10 percent of the net annual income arising from the estate is to be added to the capital.
Under this scheme:
(a) the income to be paid under the trust to the Green Gables Trust Board for the period 2 June 2001 to the present is to be paid to Presbyterian Support (Upper South Island) for the purposes of benefitting of the elderly in the Nelson Region; and
(b) the requirement to accumulate 10 percent of the income is to be restricted to a period of 80 years whereupon the capital is to be transferred to the beneficiaries under
the will.
Copies of the scheme and the report of the Attorney-General may be inspected at the office of the Registrar of the High Court at Christchurch or at the office of Wynn Williams, solicitors for the trustee, at Unit B, Homebase,
195 Marshland Road, Shirley, Christchurch. The application is to be set down for hearing in the High Court at Christchurch on 6 August 2014.
Any person desiring to oppose the scheme is required to give notice of his or her intention to do so to the Registrar of the High Court at Christchurch and to the New Zealand Guardian Trust Company Limited, trustee, c/o Wynn Williams, Unit B, 195 Marshland Road, Shirley, Christchurch, and the Attorney-General not less than seven clear days before the above-mentioned date.
