Notice of Application to Vary Terms of a Charitable Trust

In the High Court of New Zealand, Greymouth and Christchurch Registries
In the matter of the Charitable Trusts Act 1957, and in the matter of an application by the O'CONOR INSTITUTE TRUST BOARD-Applicant:
Take notice that on 21 May 2014 at 9.30am, or as soon thereafter as Counsel may be heard, the applicant will apply to the High Court at Christchurch for an order amending the terms of the trust established pursuant to the will of Joseph Eugene O'Conor dated the 25th day of September 1904 ("the will") and its administration.
The purpose of this application is to:
(a) amend the purpose of the original endowment under the will from the establishment of an institution for rearing and training destitute children of both sexes and taking charge of old people to instead provide only for an institution for the care of elderly persons in the Buller District; and
(b) to extend or vary the powers of the O'Conor Institute Trust Board under the will to enable the trustees to deal with, namely sell, part of the original estate land that is not used for the O'Conor Home to enable the trustees to carry out the trust's purposes more effectively and facilitate the administration of the trust.

The O'Conor Institute Trust Board's scheme and the Attorney-General's Report are also available for inspection at the O'Conor Home, Queen Street, Westport.
Any person desiring to oppose the scheme must give written notice of his or her intention to do so to:
(a) the Registrar of the High Court at Greymouth;
(b) the Applicant at the address for service below; and
(c) the Attorney-General at the Crown Law Office,

not less than seven clear days before the matter is due to
be heard.
Any person desiring to oppose the proposed amendment may appear before the High Court at Christchurch in person or at the High Court at Greymouth by way of audio-visual link.
