Electricity Regulations (Prohibited Electrical Appliances - Goldair Branded Wall-mounted Fan Heaters Models 3108 and 3109) Notice (No. 2) 2014

Pursuant to Regulation 87 of the Electricity (Safety) Regulations 2010 ("Regulations"), I, Mark Stephen Wogan, Manager, Energy Safety, WorkSafe New Zealand, give the following notice.
N o t i c e
1. Short title and commencement-(1) This notice is the Electricity Regulations (Prohibited Electrical Appliances - Goldair Branded Wall-mounted Fan Heaters Models 3108 and 3109) Notice (No. 2) 2014.
(2) This notice replaces and consequentially revokes the Electricity Regulations (Prohibited Electrical Appliances - Goldair Branded Wall-mounted Fan Heaters Models 3108 and 3109) Notice 2014, published in the New Zealand Gazette, 26 June 2014, No. 68, page 1927.
(3) This prohibition is to take effect on and from the date following the date of publication of this notice in the New Zealand Gazette.
2. Prohibited equipment-(1) The sale, including offer to sell, and use, including installation, of the following electrical appliances, is prohibited: All units of "Goldair"-branded wall-mounted fan heaters - Model 3109.
(2) The sale, including offer to sell, of the following electrical appliances, is prohibited: All units of the "Goldair"-branded wall-mounted fan heaters - Model 3108.
(3) The use, including installation, of the following electrical appliances, is prohibited: All units of the "Goldair"-branded
wall-mounted fan heaters - Model 3108, except that the prohibition on use does not apply to:
(a) units manufactured after 1 January 2008;
(b) units that on 27 June 2014 had been installed so they are connected directly to the fixed wiring of an installation without connection via the connector block situated on the heater mounting plate.
(4) The appliances prohibited in paragraphs 2(1) to (3) above are, for the purposes of this notice, referred to as the "prohibited appliances".
3. Description-(1) The prohibited appliances to which this notice applies are products that are used primarily in bathrooms and are intended to be wall mounted, further described below.
(2) The prohibited appliances have been sold nationally by various electrical retail outlets, most likely prior to 2010. The prohibited appliances may also have been available elsewhere including second-hand in New Zealand.
(3) The prohibited appliances have known markings that include:
(a) in the case of Goldair 3108 - "Goldair", "Model 3108", "220-240V 50Hz", "1000/2000-1200/2400 W", "DO NOT IMMERSE", "DO NOT COVER", and includes the Class II double insulation symbol;
(b) in the case of Goldair Model 3109 - "Goldair", "Model No. 3109", "230-240Va.c.- 50Hz","IP22", "Wattage:2400W", "DO NOT IMMERSE", "DO NOT COVER", and includes the Class II double insulation symbol.
(4) The prohibited appliances may also have a four digit code on the rating label or on a separate label on the underside of which the first two digits denote the week of the year it was manufactured and the second two digits denote the year it was manufactured. For example, for the Goldair Model 3108 prohibited appliances, the four digit code ends with "00", "01", "02", "03", "04", "05", "06" or "07".
(5) The approximate overall dimensions of the prohibited appliances are in each case: 23.5 x 23.5 x 13.5 cm.
(6) The prohibited appliances in most cases have an off-white coloured plastic enclosure, pull-cord operation, separate
wall-mounting bracket and a red indicator light:
(a) The Goldair Model 3108 has two power output levels.
(b) The Goldair Model 3109 has a single power output level.
(7) The figures below show examples of Goldair Models 3108 and 3109, together with examples of rating lables.

4. Details of hazard-(1) The prohibited appliances identified as Goldair 3108 are, or may be, electrically unsafe in that:
(a) the materials and components used for the construction of the appliance - and specifically the components used in the connector block - and/or the appliance itself are such that they do not function safely in both normal and abnormal conditions so as to prevent fire or the appliance overheating (Regulation 23(1)(b)).
(b) there have been multiple house fires involving the prohibited appliances.
(2) The prohibited appliances identified as Goldair 3109 are, or may be, electrically unsafe in that:
(a) the materials and components used for the construction of the appliance - and specifically the fan unit and/or heater control components - and/or the appliance itself are such that they do not function safely in both normal and abnormal conditions so as to prevent fire or the appliance overheating (Regulation 23(1)(b)).
(b) there have been multiple house fires involving the prohibited appliances.
5. Reasons for prohibition-The prohibited appliances described in this notice are, or may be, electrically unsafe as defined in Regulation 5 of the Regulations, in that there is significant risk that a person may suffer harm or significant property damage may occur as a result of dangers arising from the continued use of, or passage of electricity through, the appliances. There is therefore a significant risk of further fires associated with the continued use of appliances of the same construction that are still in use.
6. Consequential revocation and saving-(1) The Electricity Regulations (Prohibited Electrical Appliances - Goldair Branded Wall-mounted Fan Heaters Models 3108 and 3109) Notice 2014 is hereby revoked and ceases to have effect on and from the date this notice comes into force.
(2) Despite the revocation in paragraph 6(1), the Electricity Regulations (Prohibited Electrical Appliances - Goldair Branded Wall-mounted Fan Heaters Models 3108 and 3109) Notice 2014 continues to have effect for the period commencing on
27 June 2014 and ending on the day before the date on which this notice comes into force.
