Otago Rural Fire District Constitution and Administration Notice 2014

Pursuant to sections 4(1) and 8(1) of the Forest and Rural Fires Act 1977 ("the Act"), the National Rural Fire Authority hereby makes the following notice.
N o t i c e
1. Title and commencement-(1) This notice is the Otago Rural Fire District Constitution and Administration Notice 2014.
(2) This notice comes into force on 1 July 2014.
2. Constitution of Otago Rural Fire District Notice-(1) The areas set out in the Schedule are constituted to be a rural fire district to be known as the Otago Rural Fire District.
(2) The trees and other plants on the land described in the Schedule are specified to be the property for the protection of which the rural fire district is constituted.
3. Constitution of the Otago Rural Fire District Committee-The Otago Rural Fire District Committee is constituted as a rural fire authority.
4. Administration of the Otago Rural Fire District-(1) For the purposes of the Act, the Otago Rural Fire District must be administered by the Otago Rural Fire District Committee.
(2) The committee consists of seven members as follows:
(a) Two individuals appointed, in writing, jointly by the chief executives of the Dunedin City Council, Central Otago District Council, Clutha District Council, Queenstown-Lakes District Council and Waitaki District Council; and
(b) The New Zealand Forest Owners Association, which must nominate, under the signature of the president of the Association, an individual to represent forest owners in the district; and
(c) One individual appointed, in writing, by the Director-General of the Department of Conservation; and
(d) Federated Farmers of New Zealand (Otago Provincial District) Incorporated, which must nominate, under the signature of its chair, an individual to represent farmers in the district; and
(e) One individual appointed, in writing, by the
New Zealand Fire Service National Commander; and
(f) One individual appointed by the other members of the committee (or a majority of them) as an independent member with recognised governance experience.
(3) For the avoidance of doubt, the independent member
has the same rights as the other members of the committee, with the term of appointment to be in accordance with the Forest and Rural Fires Regulations 2005.
(4) If any appointment to be made under clause 4(2) is not made within three months of the date that this notice comes into force, the National Rural Fire Officer may remedy that default by appointing such person to the vacancy as the National Rural Fire Officer considers appropriate.

Land Included in the Rural Fire District
(1) All those parcels shown on SO 23106 lodged in the office of the Chief Surveyor, Otago, labelled "Waitaki District"; all those parcels shown on SO 23112 lodged in the office of the Chief Surveyor, Otago, labelled "Queenstown-Lakes District"; all those parcels shown on SO 23130 lodged in the office of the Chief Surveyor, Otago, labelled "Central Otago District"; all those parcels shown on SO 430133 lodged in the office of the Chief Surveyor, Otago, labelled "Dunedin City"; all those parcels shown on LG-072-2013-W-1 lodged in the Office of the Local Government Commission Wellington labelled "Clutha District".
Land Excluded from the Rural Fire District
(2) Excluding the following parcels shown on SO 12110 lodged in the office of the Chief Surveyor, Southland, and SO 24627 lodged in the office of the Chief Surveyor, Otago, labelled "Southern Plantation Rural Fire District": BBB, EE, EEE, JJ, NN, OO, PP, QQ, RR, SS, TT, UU, VV, WW, XX, YY, ZZ; and excluding the following parcels shown on SO 302513 lodged in the office of the Chief Surveyor, Otago/Southland, labelled "Additions to Southern Plantations Rural Fire District": A, B, C, D.
(3) The parcels excluded under Schedule (2) will be integrated into the Otago Rural Fire District two years after the date this notice has come into force.
(4) Excluded from the Otago Rural Fire District are all "fire districts" as defined in section 2 of the Fire Service Act 1975.
