Pursuant to section 11 of the Electricity Industry Act 2010 ("Act"), the Electricity Authority ("Authority") gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice is the Electricity Industry (Exemption No. 194 (Transpower
New Zealand Limited)) Exemption Notice 2014.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.
2. Exemption-Transpower New Zealand Limited ("Transpower") is exempted from complying with the requirement in clause 12.15(1) of the Electricity Industry Participation Code 2010 ("Code") to provide a copy of each transmission agreement to the Authority.
3. Term-This exemption expires at the close of
31 December 2015.
4. Reasons for granting the exemption-The reasons for granting this exemption are:
(a) granting the exemption meets the requirements in section 11(2) of the Act for granting exemptions;
(b) an alternative proposal for submitting equivalent information about transmission agreements, submitted by Transpower, is consistent with the intent of clause 12.15(1) by providing transparency of transmission agreements with designated transmission customers;
(c) the equivalent information will be more readily accessible to interested parties via Transpower's information disclosure web portal;
(d) the exemption will reduce Transpower's compliance costs associated with certifying the transmission agreements before providing them to the Authority;
(e) the exemption will reduce the Authority's compliance costs associated with publishing the transmission agreements; and
(f) the requested exemption will have minimal impact on market participants or service providers, and will not affect any other Code provision.
