The applicant claims the easement is redundant by reason of the circumstances set out below.

Easement: Pedestrian right of way marked "A" on DP 383905 comprised in Certificate of Title NA114A/775 appurtenant to Lot 1 DP 458459 (dominant tenement) comprised in Certificate of Title 597181 created by Easement Instrument 8431951.1 registered on 4 March 2010.
Circumstances: The dominant tenement has become physically separated from the servient tenement due to subdivision shown on DP 458549.
