The applicant claims the right to convey water is redundant by reason of the circumstances set out below.

Easement: Right to convey water over and along that portion coloured green on the plan within the easement created by Transfer 469531 - 22 March 1950 at 1.41pm.
Circumstances: Parts of the dominant land have become physically separated from the servient land as a result of subdivision of DP 58333 and DP 103531.
