Notice of Intention to Take Land and Easements for Kotuku Detention Dam-Whangarei District

Notice is hereby given, under the provisions of section 23 of the Public Works Act 1981, that the Northland Regional Council proposes to take the land described in the Schedule hereto ("land") or easements for rights to detain and drain stormwater ("easements") over the land.
The land and easements are required to detain and drain stormwater over that land which is within the boundary of the dam storage reservoir of the proposed Kotuku Detention Dam ("dam").
The Northland Regional Council proposes to construct the dam to mitigate river flood risk in the Whangarei City central business district.
Part of the dam storage reservoir for the proposed dam is located on the land.
The intended taking of the land and easements is considered reasonably necessary to enable the construction and on-going operation of the dam.
The Northland Regional Council has assessed a range of flood mitigation options for the Whangarei central business district, and no better alternative sites or other methods of achieving flood mitigation to the Whangarei City central business district were identified that were more favourable than the dam.
The land use is in accordance with the designation included in Part 4 (Schedule 85.2.9 Northland Regional Council) of the Operative Whangarei District Plan which provides for the detention dam.
The owners of the land and those persons with a registered interest in the land have been served with notice of the Northland Regional Council's intention to take the land or an interest by way of easement in the land and their right to object.
Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Justice Department, Private Bag, Postal Centre, Wellington, within 20 working days.
If any objection is made in accordance with this notice,
a public hearing will be held with the right of the objector to appear and be heard personally unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

The land to be taken is:
A The land situated at 18 Kotuku Street, Maunu, Whangarei, comprising 600 square metres, more or less, being
Lot 7 on DP 136445 as described in Computer Freehold Register NA80B/884.
B The land situated between the ends of Kotuku Street and O'Shea Road at Maunu, Whangarei, comprising 16.1050 hectares, more or less, being Lot 1 DP 151239 as described in Computer Freehold Register NA90A/741.
C The land situated near the end of Kotuku Street in Maunu, Whangarei, comprising 4.0010 hectares, more or less, being Lots 2 and 3 on DP 151239 as described in Computer Freehold Register NA90A/742.
The interests in land to be taken by way of easement are:
A Those parts of the land situated midway between the ends of Kotuku Street and O'Shea Road in Maunu, Whangarei, being part Lot 4 on DP 19724 as comprised in Computer Freehold Register NA478/206 (part cancelled) comprising 4788 square metres, more or less, and 1.0161 hectares, more or less, such areas being marked with the letters "A" and "B" respectively on SO 467829.
B That part of the land situated at 14 Kotuku Street, Maunu, Whangarei, being Lot 6 on DP 136445 as described in Computer Freehold Register NA80B/883 comprising 171 square metres, more or less, as marked "E" on SO 467829.
C That part of the land situated near the end of Raumanga Heights Drive in Raumanga, Whangarei, being Lot 1 on DP 77316 as comprised in Computer Freehold Register NA105B/528 comprising 4.1200 hectares, more or less, and being the area marked "F" on SO 467829.
D Those parts of the land situated immediately to the west of Raumanga Heights Drive in Raumanga, Whangarei, being Part Lot 1 on DP 86583 as comprised in Computer Freehold Register NA105B/527 comprising 6394 square metres, more or less, and 1.3407 hectares, more or less, such areas being marked with the letters "H" and "I" respectively on SO 467829.
E That part of the land situated at 13 Kotare Crescent, Maunu, Whangarei, being Lot 17 on DP 59265 comprised in Computer Freehold Register NA14C/444 comprising 617 square metres, more or less, and being the area marked "L" on SO 467829.
