Restriction Created-Mangatawhiri Road, State Highway 2, Mangatawhiri, Waikato District

Pursuant to section 236 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Natasha Pollard, Land Information New Zealand, declares the land described in the Schedule ("Land") to be subject
to the following restrictions.
Definitions
Land means the Land described in the Schedule.
Owner means the registered proprietor of the Land from time to time.
Shelter Belt means the hedge located on the northern boundary of the Land.
1. To ensure that the Shelter Belt remains sited in its current position, no person shall:
(a) Remove, burn or cause or permit to be removed or burned any part of the Shelter Belt unless the prior written consent of the NZ Transport Agency has been obtained in accordance with Clause 3 of this Notice; and
(b) Allow or permit cattle, sheep, horses or other livestock to enter, graze, feed or otherwise damage the Shelter Belt; and
(c) Allow the Shelter Belt to fall into disrepair.
2. As a requirement of the siting of the Shelter Belt and to better secure the obligations in clause 1(c), the Owner
of the Land will maintain the Shelter Belt at all times
as follows:
(a) The obligation to maintain the Shelter Belt shall include watering, weeding, trimming, cultivation, insect and disease control, pruning and other accepted horticultural operations to ensure normal and healthy plant growth.
(b) Pruning of the Shelter Belt shall be carried out
as required to maintain good form and vigour, to encourage bushiness and to remove dead, diseased or dying branches. Some shrubs may need to be cut back hard to encourage growth from the base.
(c) Any vandalised or defective plants shall be removed and replaced. Replacement plants must be planted during the planting season immediately following their loss. Planting shall be done to a standard that
is fit for purpose.
3. Should any person wish to remove or alter any part of the Shelter Belt, the Owner shall first obtain the written consent of NZ Transport Agency.
4. The covenants contained herein shall be enforceable only against the Owners and Occupiers from time to
time of the Land.
